    the answer is yes,if you havent seen the AST prior to placing the holding deposit. Some will wilfully refuse to let you see the AST until you pay the holding deposit back

    If the letting agent then says its your choice you have pulled out because of your choosing you no longer want the proeprty and therefore you will forfeit some or all of the money, speak to your local freindly trading standards team who will make sure that the agent is fully informed of what is and what is not " unfair contract terms" , they cannot deduct for this.

    If he wants to smoke tell him buy his own house,then he can smoke as much as he wants.(thats if he can still afford to)

    BUT there have never been any successful cases with regard to smoking OR pets as far as I can see. I very much doubt there ever will be.

    Those are NOT unfair conditions.

    But its not is it!the OP wants to be able to make a choice to smoke in his own HOME. The LL does not want to offer this opportunity.

    Some landlords dont mind smokers and it is not on the AST so the OP should buy a service from someone who meets his needs.

    Surely the tenants rights to do whatever is legal in his own home is more important to the tenant. Why should they waste time with a LL who wont support what they want to do ( totally legally)

    this gets my goat massively i have to say. Along with LLs who stipulate you cant put a political poster in the window and other bonkers "requirements"

    A good precentage of smokers never smoke in their own house.

    Yes, it would be interesting to see if that OFT advice would be upheld given that smoking and pets necessarily result in a risk to the landlord's property.

    Landlord insurance doesn't usually even cover pet damage and smokers pose a higher risk of a house fire.

    I have some sympathy with landlords asking that political posters not be displayed as these could attract acts of vandalism and destruction of property and the tenant won't be the one who has to pay for the damage he has provoked.

    So what about my rights [as a non-smoker, in a flat than is non smoking] not to have to put up with cigarette fumes from the tenants below us?

    Maybe I should charge them everytime I have to purchase Frabreeze to keep my home smoke free?
