My local council write and say they will apply the largest deduction unless, or until, they have proof of lower income.

However, they just say they will assume they are earning the highest amount and apply that deduction. They don't say it will be x amount per week.

I think it's to ensure people give the information promptly.

It's better than doing it the other way round and then some people having huge overpayments.

    Hi Best

Totally agree but a little more info' wouldn't go a miss......
Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.

Where i work we no longer assume maximum nondep deductions anymore. We suspend the claim, and write to the claimant asking for the info about the nondeps income, student status etc.

Another thing to be aware of op is, is your mum over 65? If she is then when you have a change in income that will affect her benefit, so non dep deduction. Then there willbe a nondep delay so any change in your income won't be applicable for 26 weeks after the change.

I would just supply the la with your student status they will amend it for you. They have just assumed max deductions

Wow, that's even crueller than deducting a high non dependents sum from their HB. I bet you get a few tenants shouting at you!

Are tenants with their relatives changing from dependents to non-dependents really that bad at reporting these changes because they can't handle a modest deduction from their HB when their non-dependent starts earning money?!

I know, I am not sure why we changed our policy tbh?

But generally yeah the claimants in my area are very bad at telling us changes, personally I think it makes better sense to apply the max deduction rather than suspending the whole claim but it seems to be working and we get the info straight away

The claimants aren't too bad with the suspensions, we do lift them quickly.
