If you have 11 full years you add that to the date of notice to determine the date for termination if it is later than the termination date(which it will be ifthey pay PILON) to detemine the date for service for redundancy.

So if the date for 12 years service is in the next 3 months there may be an opportunity to add a year to the redundancy so having a rep present might be a useful delaying tactic if dates are close.

Don't forget accrued but untaken holiday.

Notice starts the day after it is given

Also ask for access to outplacement services

Thanks for the advice guys! However, I’ve spoken to the union this morning and have been strongly advised not to meet without the rep after all. And so I’ve spoken with HR officer this morning and said I will be sticking with the original arrangements to meet next week. So glad I did as HR officer got a bit funny and said they were actually doing me a favour! Trying to get it all sorted out for me as quickly as possible.

Yeah, whatever! I don’t think so – it would have lost me 1 week’s extra pay for a start! (I hadn’t even thought of that until union made me aware - didn’t say that though).

I also brought up the fact that I should be entitled to 11 weeks notice (as per my contract) and at first HR disputed this! Said it should be 1 months notice! It seems that newer contracts only offer 1 month’s notice – and so they were thinking this applied to me. Luckily I still have my original contract so can prove it. (They did back down when they checked the records and saw I was right). Thank god! As I need that extra money!

HR then said that they may want me to work my notice “as my skills are still needed”? I think I need the union rep to help me negotiate on this as surely it’s not fair to make me stay 11 weeks!!!!! And so it got a bit argumentative between us. And I thought “if they get like this at the meeting (which is more than likely) I would feel really intimidated without someone on my side”. So I’m sticking with meeting next week with the union rep as arranged.

I will definitely bring up subject of ‘outplacement services’ – Thanks getmore4less. If anyone else has any other advice I’d be really grateful for it. Thanks guys!

Rubbish HR trying it on, contractual notice cannot be less than statutory notice which is 1 week per year of service up to 12 years/weeks.

They can have you work notice or even have you on garden leave if no work, so union rep is a good idea to get PILON.

Please, please can someone advise? I have found out today that my employer expects me to work my 11 weeks notice. Is there any way I can argue against this? Surely it is unreasonable to ask someone to work this? I need to leave to get on and look for another job. Anyone know what my options might be?

What I don’t understand, and whuy I am so shocked that he is saying this, is that other people who have been made redundant recently have finished within a week of their hearing. Why am I expected to stay when my old job has been made redundant and the new job/s I’ve turned down as unsuitable so what job am I actually expected to do? If there is work for me to continue to do for another 11 weeks then why was my role made redundant in the first place? Any advice would be really, really appreciated!

What does you contract say? You need to work the notice period of your contract - what other people have done is not relevant to you.

But you can get reasonable time off to attend interviews etc - can not remember exactly what you can get - but search for being made redundant rights - there is a good government site out there.

I really didn't think I'd be expected to stay for all this time?

I feel a nervous breakdown coming on and a trip to the doctor to be signed off with stress!

Thanks Mark. I will, but I don't understand why they would want someone to stay working for them who is obviously only going to do a half-hearted job?! The atmosphere is already toxic here! I really don't think I can stick it for another 11 weeks!

Just think about the money - that 11 weeks gives you 11 weeks more time to find another job.
