Ex-Tenant - Cheeky mare!

I had a tenant last year who suddenly decided that her Housing Benefit/Local housing Allowance was sent to her so she could have drinks parties (confirmed by a look at her Facebook Pages)

After running up debts of £1819.50 she clears off.

My fab Property Manager tracks her down to her new address, persuades the new landlord to let him manage the property and then pays the little madam a call regarding her debts to me.

We send her the Bailiff letter and the response.....

"oh I am a 1 parent family and I can only afford to pay you back at £3 per week!"

Oh joy - you will have cleared your debt off in 12 years - I don't think so.

I am going back for £20 per week and will settle for £10 per week

What do you think? Should I just send in the bailiffs for starters?

    Good luck with that is all I can say. Because she will no doubt be able to prove she can only afford to pay you £3 a week and you will have no choice but to accept it.
  • No I will just produce all her Facebook pages and this will undoubtedly show she has more disposable income than £3 per week :rotfl:

    Fail to see your problem, & why she is a cheeky mare (bit insulting IMHO). She's just wanting to exercise her legal right, just like you are with the bailiffs. Or does that make you a cheeky mare also?

    Hopefully she'll get LSC legal aid to defend against you.

    NB when did you get the court judgment???

    why allow that much debt over what time period ?

    now you are seeming no better than her in being untruthful if you claim 20 and yet state you equire 10 ???

    waste of bailiffs fee unless you think they will get the cash. very unsure myself.

    As A taxpayer all my life - I have effectively been giving her the housing allowance - she chose to !!!! it up the wall instead of paying rent. the court judgement was in September 2010.

    She can afford more and I intend to get it - one way or another. And I repeat she is a cheeky mare - sooner she gets her !!!! out of bed and into a job the better as far as I am concerned - I will be delighted when the dole take a good long look at her situation. She has one child - as do I - I am also a single parent but I don't run around bleating and expecting others to support me

    You're seriously supporting the idea that people should be able to evade debt?
    We might as well fold MSE then, spend what you like and don't bother paying. Doesn't matter what it costs, you don't pay anyway.

    You like to side with the tenant, usually you're right, but not on this, not from what has been presented.

    So, in diverting the taxpayers hard earned cash away from financing your personal B2L empire, she has taken the opportunity to plough that money into the local economy, creating growth, employment and good cheer all round, particularly with the hard pressed entertainment/drinks industry. She's even been industrious enough to spread the joy on facebook.

    Money well spent, I say.

    As far as I am aware unless you have had previous money problems or mental health/capacity problems all HB is paid direct to the tenant.

    How it's paid

    If you are a council tenant, your council will pay any Housing Benefit straight into your rent account.
    If you're not a council tenant, your Housing Benefit will be paid:
    • to you by cheque
    • by Direct Payment into your bank or building society account

    Contact your council if you're worried about how Housing Benefit is paid.

    Actually Housing Allowance is just that - for housing i.e. rent

    As soon as she was two months in arrears I started proceedings (you cannot do it earlier)

    Easy to find new landlord - small place Wales :rotfl:

    I will prove it - will have photographic evidence and witness statements to back up my claim.

    As for only requiring £10 pw - rubbish - I am installing a brand new boiler in her former home next week at a cost £1450 - I should have that in reserve except she never handed it over for her housing

    As for Bailiffs - maybe I will not go down that route - plenty of lads looking for cash in the hand work round here. Payment on results

    Jinky - 2 months arrears and then third month to get her out - standard practice to not be able to serve notice until they are 8 weeks in arrears
