That's kind of how I feel, but it could still be a problem. I've just spoken to Consumer Direct who advise me my contract is with the original dealer and this could be considered consequential loss. They suggested I may end up having to pay under protest to get the car released, and go to court, as only a Judge could decide whether I would be liable for those investigation costs.

She didn't spend long on the phone with me so not sure whether she fully appreciated the ins and outs of what I'd told her. My main point is I didn't actually intend to authorise any work, just give consent to proceed - with the understanding that Renault UK were paying.

Really praying for this situation to end soon, getting really stressed about it again now.

Have spoken to the original dealer a little while ago who is again in touch with all parties and trying to sort something.

Do you have any legal cover on your home or motor insurance? If you do, ask them the same questions and what the likelihood of a successful case is, against all parties in the sorry tale.

I already checked that though thanks for the thought. No legal cover on the home insurance - and the legal cover I have for motor relates only to accidents involving a third party.

The trouble with this situation is it's basically a he said/she said kind of thing. The good news is no-one (at least at the moment) denies my version of events, which is completely true! The problem has simply arisen out of poor communication and misunderstanding.

Finally the end is in sight!

Good news - Renault UK have agreed to pay the investigation costs (albeit at a reduced figure as the repairing garage knocked their costs down some way). I am not being asked to contribute any more than the 5% of the repair bill at £339 total.

A courtesy car should be with me this afternoon, and I'm just starting to come down from my stress related high. Maybe baby will be ready to be born soon :)

Very pleased that Renault Uk, and Renault in general have come through for me in the end. They have been nothing but fair and honest with me, even if the discussions over who would pay what took several days. The he said/she said situation could easily have turned against me if anyone had been dishonest and changed their story. In a future situation I would try to do everything in writing, but thankfully all sorted happily now.

Any further problems I will of course keep you posted!

Glad to hear a bit of persistence (well, quite a lot actually ;)) has paid off. Well done.

    Agreed, well done.;)
  • First of all, good luck with the new arrival. It'll be the dealers labour charges that will be vastly inflating that engine price, exchange engines will be available at a fraction of the cost of a newly manufactured one. Unless the selling dealer wants to end up with a very messy court case and with a customer who will tell everyone they know not to buy Renault it makes no business sense to leave you in the lurch. I really hope common sense prevails here.

The way I understand the case is that the OP must contribute 5% of the cost which is £339, so the total price will be over £6500.

I think you will find that the OP is getting a brand new engine for that price.

It doesn;t take that long to fit a complete engine, even a main dealer would be hard pressed to charge more than 15 hours labour.

A complete new 1.6 VVT engine probably costs about £4000, a total guess, it may be less.

Renault will be supplying the engine to the dealer and more than likely the dealer will be charging Renault themselves for the labour involved.

Remember this is Renault customer services that have agreed this deal really, not the dealer.

Though I reckon the dealer was trying it on with the investigation costs.

Under SoGA the dealer was surely legally bound to investigate this problem which was almost certainly there when they sold the car.

I am glad that after all this stress the OP has many more happy miles in her Renault, and good luck with the new baby.
