So I don't see how he isn't entitled to it then ?

I know what it says above in above in blue .. but technically, and it is worded that way, He's NOT entitled to JSA because he's been sanctioned.

They can't have it both ways.:cool2:

For condition of entitlement 9 to be considered, you must satisfy condition of entitlement 8 'prescribed category', and unfortunately this person would not. There's an 'and' at the end of each line which allows it.
  • Its a sad situation, however in life there are consequences to our choices we make. Sounds like (and please correct me if wrong) but your friend was dismissed for gross misconduct. The 6 month sanctions are generally for that, or willfully leaving a job or failing to attend a training opportunity. Unfortunately, if they didnt sanction people who were sacked for misconduct issues, the jobcentre would be full of scrotes who deliberately got themselves sacked so they could go back to sponging off everyone.

I'm not saying your friend is doing that, i do find it hard believe they absolutely no friends or family that would help them for a short time. It really annoys me that people think they have a right to everything being handed to them when THEY have made the wrong choice. Or is it all a conspiracy theory that forced your friend out of his job?

Crisis loans is a seriously abused system, the good news is in a few years it will be back to having to prove you are destitute to your local authority rather than ringing up on your iphone and getting the money paid into your account without you even having to get out of bed!

This his new status thanks to the good people at the DWP.

This should be there new slogan ..

Claim JSA as a decent hardworking, tax paying citizen of the uk - Leave as a homeless vagrant.
    Our Sanctions Promise!!
That's a rather subjective point considering he was dismissed.

Well you,re not entirely correct there.
They have and he has the right to request that.
However, it seems you thought DX was right a couple of posts ago:

That's a laugh, they won't even aknowledge that the law says a person needs a minimum amount to live on.
When you ask for this in writing they won't give it to you or they deny that it exists.

apart from dmna's post, above which is quite correct, he IS in fact entitled to JSA, but while a sanction is in place the AMOUNT of JSA he is entitled to is NIL. It's picky I know, but that is the case.

"A claimant has to be entitled to JSA before the DM can impose a sanction."

As Cassie says, it's something that runs round and round in circles. As someone who may or may not be a DM for obvious reasons on this forum (my name might be a clue to anyone who knows about such things), half the trick, believe me, is understanding the clauses and caveats as required. JSA entitlement is there, at a NIL amount, for the duration of the benefit sanction, whereas IS entitlement unfortunately isn't.

Crisis Loans (don't confuse them with hardship payment or you WILL be in a pickle cause they are totally different things) run on a different set of regulations altogether unfortunately.

My friend has paid taxes since he left school, as has his father, as has his grandfather.

It looks as though you are mistaking tax for a savings account.
