    Change posts ..what do you mean ..like PPCs and their debt collectors change what statute law says and lie to people about it ?

    Whatever the issues around how disabled bays should be used on a moral basis that doesn't change the simple fact that imposing penalties in a contract against persons parked in advisory disabled bays who don't display a blue badge will not stand up in court.

    Whether PPCs care to admit it or not threatening people with a court action when you have no intention of pursuing it nor any chance of winning it if it is defended is nothing more than fraud and demanding money by menaces.

    Now that I have given details about the Exeter case (UKCPS v Oxenham, Exeter County Court 17-01-2011 case reference 0QZ11447) are you now willing to comment on the outcome?

    I would also welcome your comments on the name of the debt collector you use; "Court Proceeding Ltd" - complete with scales of justice logo. Would you agree that the name and letter-head are designed to fool people into thinking it's some sort of official body?

    A PPC will argue that without a blue badge how are they to know someone parking in a supermarket disabled bay has a genuine disability.

    That is not our problem.The PPC has set up a business to 'police' these car parks, and it is not for the motorist to do half the job for them

    How is anyone ever to know that someone has a disability unless it's obvious or they tell you? No-one has the right to ask - and to harass disabled people in any way is illegal anyway. That's why the use of these bays should not be restricted by anything except a notice with a clear, polite advisory instruction.

    Seems pointless debating this when it all boils down to making money. Looking out for the needs of the disabled is a smokescreen, and disabled charities are obliged to support anything that appears to magically solve the 'problem' of disabled bay abuse. To do otherwise is to appear to act against the interests of disabled people.

    The mechanics and legalities of disabled spaces on private land are irrelevant to them.

    Let's get this straight. Very few people 'abuse' disabled bays. Most people are not heartless idiots. There are more than enough disabled spaces in the vast majority of developments.

    Where the money is made is divided into five groups, in descending order of cash revenue:

    • thoughtless people who nip into a shop for a small purchase and park near the door for a short period
    • disabled people who misplace/forget their blue badge
    • heartless people who don't care and park in disabled bays though laziness
    • disabled people who are not in possession of a blue badge
    • oblivious people who park in poorly signed or marked bays

    A PPC doesn't care which group you belong to, hence genuinely disabled people are the ones who inevitably suffer at the hands of profit driven private companies.

    Personally, I think councils should take over the policing of disabled bays on designated private land. Any revenue would go to the council and away from the Hasbeens. DPT guidance should give grace to those who are in possession of a badge but who forget to display or misplace.

    Fairness would take precedence over revenue, blinkered charities would be happy and grabbing private companies would be shunted out of the picture.
