eBay Unpaid Item Appeal.... How!

I think the fact you said the seller was acting outside the law got everbody's goat.
The seller persisted in requesting payment after I had told them twice that I wished to cancel the item, as I am entitled to do. That breached the distance selling regs.Plus the fact that you know all about the regulations, but haven't the brains to sit and think if you really want something before clicking a button.
But I do have the brains to buy the same items from the same seller at half the price from one of their other outlets.0 -
When you click the BUY IT NOW option it clearly states....
You're agreeing to a contract -- You will enter into a legally binding contract to purchase the item from the seller. You're responsible for reading the full item listing, including the seller's instructions and accepted payment methods.
I'm afraid that eBay.uk rules do not take precedence over UK law.
Almost all "Buy It Now" sales come with a seven day 'cooling off' period.0 -

Yes, and you were able to cancel, no one is persuing you for the payment.
The law doesn't say that any venue can't prevent or discourage from buying from them again.

This is true. I do understand that a a seller would want their listing fees refunded by eBay but I don't see why that should severely inconvenience a buyer who has changed their mind... as they are entitled to.
I have changed my mind on another item since (item not as described) and there was no problem at all. The seller responded to my communications. The whole matter was settled in an amicable and businesslike fashion.
Why is an eBay fronted business any different to any other business? I can change my mind about stuff I buy from Argos or Marks & Sparks. The only difference is that my right to change my mind on BIN items on eBay is protected by law.
I'm beginning to suspect that the seller's eBay turnover is so large that they never even realised that I had asked to cancel the sale.

They are not different, there was a thread on here last year where someone had had their Amazon account cancelled due to the number of DSR returns, and others joined in saying they also had had accounts cancelled due to their buying history.
The fact you now admit to 3 occasions of buying and changing your mind rather suggests that the seller made the absolutely correct decision in this case. No doubt you are aware that the seller would have lost their listing fee whatever you did as BIN listing fees are never returned not even if buyer does a mutual.
You might also find that there may well be a malicious bidding strike opened against you, I would certainly be reporting any bidder who bought two of my BIN items and then declined to pay, to me that sugegests a competitor out to waste my time and money.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. I can't really see how a malicious bidding strike could be opened against me as there has been no malice in my actions. I was just exploiting the DSR's to purchase item at the cheapest possible price. This website is full of hints and tips on how to exploit every opportunity to benefit from various advertising errors and special offer loopholes etc. Again. why should eBay be any different?
I suppose it is up to the seller to weigh up whether or not to risk listing items BIN knowing full well that a buyer is entitled to return it and the BIN fee lost.
I have to say that I have probably changed my mind (for various reasons) with about five items out of hundreds that I have bought, so all you worried sellers out there don't need to be too concerned.0 -

Rather says it all.
Some of us still work on the principle of my word is my bond and don't try and hide behind some arbitrary law.0 -

1 - which bit of the law has been breached?
2 - I don't believe you. Why not buy that one first?
I don't think any seller here is particularly worried about you.
You are within the law, but not the spirit of it.
"The Distance Selling Regulations were passed to protect consumers when they shop online or enter into other contracts at a distance from the supplier. The rationale for giving consumers special protection in such deals is that the consumer does not have the benefit of meeting face-to-face with the supplier and inspecting the goods or services offered for sale. "
I can't see anywhere stated the the DSR's are to enable people to behave like !!!!!!.0 -

Exactly. If I'd been in his shop I would have seen that he was selling them at half the price and bought those instead. Which is what I did!I can't see anywhere stated the the DSR's are to enable people to behave like !!!!!!.
Ha ha! That rather depends on your point of view.0
