Football is causing damage and a road safety problem

    A football smacking a panel carrying grit can do some marking, and polishing to remove these marks would remove a thin layer of lacquer/paint. The damage may not bother you, but to some people who try to keep their cars looking immaculate such marks would be a great annoyance.

    What did the football people say? I assume it's a club or someone at least owns the ground, so what did they say?

    I would assume you didn't just fire in the nukes without trying the diplomatic approach first?

    Health and safety at work act sec 3 (1) http://www.legislation.gov.uk/ukpga/1974/37/section/3

    It shall be the duty of every employer to conduct his undertaking in such a way as to ensure, so far as is reasonably practicable, that persons not in his employment who may be affected thereby are not thereby exposed to risks to their health or safety. contact the enforcing authority and request they enforce it - its their job. An improvement notice should suffice.

    And 3 (1) (b) http://www.legislation.gov.uk/uksi/1999/3242/regulation/3/made ,management regs.

    3.—(1) Every employer shall make a suitable and sufficient assessment of—


    (b)the risks to the health and safety of persons not in his employment arising out of or in connection with the conduct by him of his undertaking,

  • The bloke on the motorbike at 1:12ish was blooming lucky, dont think Id like to be side swiped by a football on a motorbike, or hit one for that matter.
    That's the one I noticed, I nearly came off my bike when a pheasant flew out a hedge straight at me, the natural reaction is to flinch, enough to alter the course of the bike!

    Would it cost that much for the club/local authority to drop a couple of 30' poles and install some suspended netting?

    I wonder what the councils stance would be if this were a cricket club, and those were heavy cricket balls heading over the fence?

    I was diplomatic at the beginning which was over a year ago. It is a private club although the club grounds are maintained by the local council under contract.

    At the beginning the club stated that there is nothing that they could do due to planning regulations and if any damage did result just claim off the club's insurance. After my car was damaged several times I had enough and reported the problem to the Environmental Department to sort out the problem.

    I was under the impression that the Health and Safety department could enforce the club to carry out some safety control measurer's with this particular issue. But unfortunately the department just stated "that a risk assessment has been made in accordance with our requirements. It remains for them (the club) to act on this assessment." Therefore the Health and Safety department cannot do any more.

    If there are any Health and Safety officers on this board please could you advise if this information is correct?

    Often the "advice" from local council enforcement officers is erm, not as accurate as it could be. Search for a documentary screened on channel 4 a couple of years back entitled the fun police - it featured a female council enforcement officer who hadn't a clue what her enforcement powers were...she thought she was unable to serve an improvement notice due to a health and safety at work act breach on a guy because he was self employed :(

    The risk assessment must be suitable and sufficient. If its not an improvement notice can be issued...here one from earlier....http://www.hse.gov.uk/notices/notices/Notice_details.asp?SF=CN&SV=300946153 (looks like a recreational facility so could be of interest).

    The Environmental Department have made it very clear to me that there is nothing more that they can do, so an 'improvement notice' is out of the question.
    It's very clear to me that the close ties between the club and my local council are influencing the outcome of any enforcement action.
