Any template letter for second bank letter to reclaim specific figure. The problem is live in Scotland so small claim rule would apply.
Would it be possible to add a paragraph to sample letter on this forum saying that I will split claims to £750 max if need be ?0 -
Use the normal template Martin has in his article. You don't need to tell the bank that you will split the claim to come under the £750 limit. Just do this if you get to the court stage (make different claims for different dates to keep under the limit).How many surrealists does it take to change a lightbulb?

hi, I am new to this too. Have just recd my statements and sent off a letter to First Direct asking for Just over £2500 in charges and interest going back 6 years. I too was confused by the £750 small claims limit in Scotland. As far as I can tell there is a few ways to get round this, firstly make several small claims for £750 or less. Secondly take out a Summary Clause, this is the next stage up from small claims and has a higher limit of £1500. Or thirdly, and this is one I am looking into, you can "hire" and english address and go through the system that way using MCOL online and can claim up to £5000.
i think everything ive said here is true, its what ive picked up from reading through various posts/sites. Any help/advise would be gratefully received.

I filed on the 7th, the claim was issued on the 8th, acknowledged on the 12th and I was paid in full on 16th and 17th (yep - over the weekend!)0 -

Nationwide and the claim was for £2.6k which came to just over £3k with interest and legal charges. When I started I really didn't believe I would get the money back but just followed the steps and it happened. Took about 6 weeks start to finish. can't tell you how welcome it is - and if it hadn't been for this site I'd never have started the process. so you're not being nosey - the more we share information and experience the more we learn and the stronger we become.

Most of us got these charges cos we didnt have enough money to start with so its great the thought of getting it back !0 -
My bank told me Scotland doesnt count to get money back so they cant do it. Is this true or just them getting out of it?0

As you can see from this thread there are differences in claiming in Scotland but you certainly can claim.0 -
Hi everyone, totally new user to this site although have spent most of my christmas hols looking at it !
I've sent my letter off to the bank(received the usual fob off) so have sent a further 7 dayer threatening court action. However, it's just dawned on me that the RO for the bank; Clydesdale (and it's branches) are in Scotland. As I live in England do I have to use the Scottish system or can I claim on-line using the English one? (claim is over £750) Any help appreciated !
