  • Hi looking for a bit of advice, i'm claiming back my bank charges form the Halifax a total of £375 they offered me £156 which i refused and am now ready to take them to the small claims court, not sure what to do now i'm at this stage few questions i need answering before i commit.

    If i go to court and i lose do i have to pay their costs?

    Does it only cost me £39?

    Not entirely sure what i do to take them to court, help needed please?

    It looks complex but it isn't so hard. I've just won a case against someone who owes me money.

    It doesn't cost a lot to use the procedure.

    And costs awarded in favour of the winning party in the court case aren't so big.
    For example I was awarded costs of £100 against the guy I challenged(on debts of £600) and this was an unusually high amount as he hadn't responded to the court's letters or tried in any way to comply with the courts letters or demands. The costs awarded are usually much lower than this.

    I am new to the whole bank charges claiming thing.

    So far I have requested my charges info from the Bank of Scotland for the 3 accounts I hold with them which I received last week (after 26 days).

    Question is, is it better to claim for them all together, or try and claim for them separately. The details of the charges I am going to claim for are detailed below:

    Current account - closed = £1513.57 including interest (£1244 without)
    Joint account - open = £4617.34 including interest (£3653 without)
    Current account - open = £2982.47 including interest (£2526 without)

    In Scotland I believe the limit for going to the small claims court is £750, so even if I tried to claim them separately I would still be over that limit.

    Can anyone advise me on what they think the best course of action is.

    I have the letter ready to go (to my local branch) but just want this final piece of info.

  • I intend to request a refund of charges from 2 bank accounts that were opened and are still registered with branches in England.
    However 2 years ago I moved to and currently live in Scotland. the bank has its head office in England.
    If the bank decides to go as far as the small claims court can I do this in England as the accounts are held at English branches, or does it now have to be in Scotland as that is my registered address?

    Any help much appreciated

    If you can attend court in England, you can take your banks to an English court.

    Are the amounts involved worth doing this or is your local court a better option?

    Not sure yet exactly what the amounts are yet but went through a huge bad patch 3 years ago, just doing some ground work at the moment so I know where I stand to tackle the infamous HSBC.
