    Is there a different procedure up here? I've heard a rumour that it's only 5 years worth that can be claimed, and that there's a different process. However I've read through Martin's brilliant advice and can't see anything about this.

    Has anyone reclaimed in Scotland that can let me know if they did it using Martin's method or a different one.

  • I have read the threads and all the info on the CAG site but am still unsure if I should be tryin for 5 or 6 years. My bank is based in Leeds so maybe in my 2nd letter (just sent off first and awaiting statements) anyway at the next stage i should do the 6 years but if i have to do the court stuff just do the 5 ? Also annoyed I will have to split up my claims as the limit is less in Scotland - im sure i will be into the thousands !!!

    why is there not a proper forum for scottish claims for over £750 ,i have spent days/weeks looking and no one seems to know the correct procedure ,help needed from someone who has successfully won over £5000 in scotland claiming in scotland

    You can use the online court process - as long as you have an address in England or Wales that can be used for mail. Very simple and straightforward, and means you don't have to do multiple claims if your charges are more than 750.

  • after reading through other posts, i am just wondering if i should claim initially for 5 years charges or 6? and should i claim for the thousands(prob apprx 2/3 but ive still to determine that) I am owed or just £750? Is it the case that they (halifax) may refund all my charges, or will they be clever and say they can only give me back £750? Or is the £750 just an amount that you can claim in court, i.s. can an out-of-court settlement in scotland be over £750? thankyou for your help.....aaah so confused but really want to do this as they have often made my families life so hard by taking all our money and leaving us overdrawn with nothing and still bills to pay, and we have 2 small children....one more question, halifax closed my account last year because so many charges, can I still claim??
