hi, can any one tell me if my retiring mother in law would be entitled to housing benefit if she rented a three bedroom house from her daughter. if so how much would it be in gateshead tyne and wear?
    all help greatly appreciated.:j

    Hi

As your mother in law is renting from her daughter the council will need to establish if the tenancy is a commercial one. Like does she has a tenancy agreement, how long she has rented from her, has the property been rented out before, what Woolf happen if she feel into rent arrears? All these questions need to be answered and satisfied.

You can them check The lha rate on here: https://lha-direct.voa.gov.uk/Secure/LHASearchIntro.aspx

And entitlement on here : https://www.entitledto.com

The biggest problem Is proving the tenancy is not contrived

Hi as you will be renting a council property lha is not applicable. Lha is for private rental properties.

However if you were to start renting a private property then yes you would be only entitled to a shared bedroom rate as now. It's one hb rule that really winds me up. The government basically saying you should live at home and you are not an adult till your 25 and now from April, 35!

Ohh thats something I didnt know, thank you, Puts my mind at rest.
I was looking at private renting depending how long or how it goes on the council waiting list
Some have been on the list for years, others ive heard from only months!
Is it just housing benefit for council rent then? and that wouldnt effect me with these new rules

Really dont like the new 35 rule, think its silly, I know they have cuts to make but 35!!! Oh and this only comes into effect from April 2012 :)

it wont affect you as you are moving next week. however next march you will have an anniversary date, and this will result in the lha rate going to the 30 percentile. but you will get a 9 month transitional protection so the lha rate will stay at 103.85 until dec 2012.

I must point out tho that lha rates change every month so the rate you quoted might change slightly when you move.

check the lha site on tuesday for the new rates :)

lha is for private rented and hb for council :)

yeah it definetly wont affect you unless you move to private rented property

The bedroom rate in my case will definitely not alter, and I have no plans to move. My anniversary date is October, so I would have October + 9 months. That is good to know, thanks!

Am so glad you asked this question and clarified the answer as I was also a bit unsure myself. I am in a similar situation in that income details changing when I return from mat leave in April but anniversary date is September. I work with benefits (housing in particular) but being on mat leave whilst all these changes have been happening, I have struggled a bit to keep up!

Oh dear you got a bit of swotting to do :)
  • My housing benefit went down £10 a week today-I thought I had a few months before I have £10 a week for food.
Thanks condems-hope your banking mates are enjoying their fat bonuses.
Everyone to the streets in London on 26 March and lets get rid of these disgusting scumbags that misrule this country.
  • I'm a pensioner without a private pension, and currently get Housing Allowance of £98.08 per week against my rent of £475 per month.

I hadn't heard about this alteration in HA until readering Martin's Newsletter this week, but after checking I find I'll be worse off by £7 a week from December 2011. This is the equivalent to my pension increases for the last two years.

So much for Mr Cameron's claim that they're not doing anything to affect pensioners.

But there again, the Tories only ever look after the rich.

  • My flat is owned by a Housing Association, so am I right in thinking these changes won't affect me?

    Many Thanks,

    Sim.
