    I Am In The Same Boat As A Few Above ,i Am Totalling Up My Charges And I Think It Will Be Around £5000,i Am Not Sure As To The Next Step As Most Claims Seem To Be For Less Than £1500 So It Is Not In The Banks Interest To Go To Court But I Am Not So Sure About My Case ,i Will Post Off My Letter Asking For My Charges Back ,do I Put In A Spreadsheet Listing These Charges Or Do I Just Put The Final Amount In?.any Help Woukld Be Great

    Do a spreadsheet , or even just a list totalling all the charges and send it with the preliminary letter. 14 days later send the letter before action, again with your spreadsheet of totalled charges. If they have not paid up in full after a further 14 days, then file a claim via moneyclaim online or with an N1 form at your local court. At this point, you can add on the 8% interest to your charges spreadsheet.

    I have recently successfully got over £4000 back from my bank (£600 of that being interest). I filed court papers, got an intention to defend, then an offer that was less than £100 short of all charges, 8% interest and court costs.
    GO FOR IT!!

    I'm doing six different claims for six different people now. I'm preparing every letter for them, and if needs be I will stand in court with/for them. It's only a matter of confidence for some people (plus I've spent a LOT of time studying the process, so understand it a bit better).

    apparently the 3rd parties have no more power than doing it yourself, except your not giving anybody access to your account details if you do it yourself.

    Providing you follow the rules on the 10 step guide you cant go wrong. Is that 7000 in total or with interest. as each claim has to be below 5000 without interest to go through a small claims court.

    i know i can split but after spending days on these forums i am not sure if i can claim against them in english courts ,if not max scottish claim is £1500,unless i go for the full claim in an ordinary court
  • As you are taking the bank to court it has to be your "local" court and as you live in Scotland you will come under the Scottish Jurisdiction.

    just to say how great it is that martin and other mse'rs have compiled and written all the letter templates etc free of charge. :T :T
    i have just come across a website called 'bank complaints' who do start on a no fee/no win basis and do all the work for you but if you win they take 25% of your win!!
    so if you won £1000 they are going to take £250!!!
    madness. all they are doing is what we are!!!
