Debit card fraud... bad day for me.

    I think number 1 you described is happening less these days as a large amount of card machines now require the user to insert and remove the card themselves, as opposed to the assistant doing this. This therefore practically eliminates any chance the assistant has to even come into contact with the card.

    Obviously still a problem in certain retailers such as restaurants, where assistant-operated wireless machines are used.

    :mad: I noticed £100 had been taken from my account VIA a cash machine. so i called the bank to investigate, they went on to tell me the time date and place the money was withdrawn from. I knew i hadnt withdrawn this money as it took place the week before, i was also at work off the time the transaction took place. my bank went on to tell me i had to contact the police to get a crime ref number which i did. i then went back to my bank to be told they will not be dealing with my case as the money was withdrawn useing my original bank card nad PIN ( which is ABSOLUTELY impossible as i had my card in my purse in my bag and i was clocked in and sat at my desk at work which i have evidence of) they werent having any of what i said, told me someone else must have used my card (i dont keep my PIN on paper i keep it in my head, also noone else knows my PIN)

    i then went back to the police they told me they would need to look at the CCTV footage from that bank BUT if they dont have CCTV i basically dont have a leg to stand on and i wont be able to claim my money back.

    Can some one pllllllease help me! If this doesnt get solved through the Police and CCTV is there anyway i can take this further?

    I just noticed 5 suspicious transactions on my account, I phoned my bank to block the debit card, someone just had fun using my money for bets, The card was all the time with me so it is impossible that i used it for bet-company, I just don't go to places like that,I am reading all the stuff about hacking and copying cards, and it must be the way they obtained my card details. Anyway I went to the police station, what they said to me is, that I have to provide bank statement with exact time and date when the transactions has been made. Even if I get that but cctv form bet-company and ATMs will not show face of the person who used my card, will I still be able to get refund?

    Contact your bank to deal with this as fraud. The betting transactions will probably have been made online.
  • I was having trouble remembering my PIN in order to pay a taxi driver the other night. It's a new number and I often get the digits mixed up. He got irate and aggressive with me, getting out of his cab and asking to see my card to show I wasn't pulling a fast one (which was what he ended up doing, of course). Like an idiot, and thanks to a few drinks/feeling intimidated, I showed him the card and he seemed satisfied, jumped in his cab and off he went.

    The next morning Lloyds called me to say they'd noticed suspicious activity, which amounted to someone spending £1100 of my cash in places like Iceland, Bargain Booze, JD Sports and Argos. The fraud investigation team are now looking at it, after I had to wait 4 days for the transactions to clear, and the Police have basically said the bank take the lead on these things.

    What happened was the driver switched my card with another Lloyds debit card, which I only realised on checking my wallet the next morning, and must have spied on me using my PIN, and guessed the correct combination, coming back to withdraw £300 before going on his spending spree.

    I'm not confident about them giving me all of the money back, as I expect they will argue that I was 'negligent'. However, since the bloke pushed me over my overdraft limit (£813 in the red at the close of play), I was wondering if the Consumer Credit Act would cover me, as it appears any overdraft charges (minus the first £50) need to be covered by lenders. Is this accurate?

    The Consumer Credit Act doesn't cover debit cards, only credit cards. You will be refunded for any of the fraud that was debit funds (the portion of your overdraft which was used) and probably hold you liable for the amount taken from credit funds. The other thing they will look at is the time you reported the card missing, it's your responsibility to know where it is at all times, the fact that you were a bit worse for wear wont be taken into account. If you can convince them that the card was stolen you might stand a chance but as you didn't report it stolen until they called you, i wouldn't hold your breath !

    I had my natwest debit card cloned a few years back.
    I was already about £1.7k od but despite the fact I had a £2600 od limit, the bank generously allowed them to run this to over £3.1k.
    It took a couple of weeks of headaches and signed legal statements with dire warnings to sort out, I had to go cap in hand to the branch to get my OD limit raised to cover any SOs and DDs too.

    I still had the card, and hadn't lost it out of my wallet or let it out of my sight or disclosed my PIN, I think it was very wise I was so adamant about this on my claims as Natwest fraud did try and get me 'to confess' I had been careless with it.
    I got all the funds back in the end, but what a palaver!

    I did suggest their fraud department might try tracing the thief as tickets to edinburgh on easyjet were bought (still need photo ID for internal flights) they were uninterested.
    The 'purchases' they made were definitely not my normal spending habits (gambling, air flights and train tickets, none of which I have ever done on debit card) either, and I am still miffed they allowed them to surpass my OD limit when if it had been me wanting to do this they would probably have stopped me!

    It seems that some petrol stations in Bristol were fitted with cameras above the fixed PIN terminals at the time.

    Back on subject: if the Previous poster had not noticed his/her card was stolen at the time it could be argued that s/he is now reporting it as soon as s/he was aware.
    Again: normal spending habits would come into play as s/he will be able to show it was not normal for him/her to notice immediately.
    The taxi driver should be very easy to trace from the transactions, the poster can identify him no doubt, and hopefully some ANPR cameras will show his vehicle at the time of the theft and subsequent purchases using the stolen card.

    Hardly requires Sherlock Holmes to sort out after all.

  • this has happened twice in the last year. Someone used ATM's to take about £3000 from my account. They started slowly from cash machines I used and I only noticed when some huge amounts came out.

    I think I'll have to kiss goodbye to it as I can't prove it wasn't me. I'm aware the banks say that it has to be your card and pin that was used, but it really wasn't. In addition I've had my card with me the whole time and nobody else knows my pin. I have no idea how someone has managed it, but they have! The same thing has happened to my other half at the same time as me. They are even claiming I have managed to travel 3 miles in the space of 2 minutes to do this :(

    Worst thing is that I work in finance and I am on rubbish pay and really can't afford this

    You don't have to ! The bank has to prove it was you or that you were grossly negligent with your card/PIN.
  • Yesterday i notice my Clydesdale debit card had been used on 2 occasions total of £130.00 When i phoned the bank, they advised one was in morrisons and the other in marks & Spencer in Wigan. the bank advised it was a card transaction so they think i was present and wont refund the money, tried to explain i live in the very far North of scotland. but they still wont budge took them over a day to cancel my card as they forgot when i first phoned, police say chances of catching anyone are remote. So i have just lost £130.00 so much for chip & Pin
