    Weightmans were pretty good when I got made redundant. One tribunal later and all we all went off into the sunset.

    I've not come across too many employers (i.e. almost none) that would be foolish enough to go to ET on the grounds that a new role was in fact suitable for someone who genuinely thought otherwise.

    Redundancy is far cheaper and easier.

    I'm also quite dubious about the fairness of making people work notice periods when all their functions have been taken away. Gardening leave thanks.

    UPDATE....

    Have been given redundancy!!!!! Plus PILON of 11 weeks.

    I still have one question though...

    I'm officially on 'gardening leave' for the 11 weeks. I questioned my situation regarding our bonus scheme. We have quarterly bonus, so I've already had quarter 1 this year (Jan - Mar). For my quarter 2 bonus I've been told I wouldnt qualify as i have to be employed by the business at the end of the second quarter to receive this - I've only been here for 2 of the 3 months this quarter so far. If i'm on gardening leave does this not mean i am still officially employed and would therefore qualify??

    Not sure if this makes sense to anyone - if it doesnt, let me know and I can see if i can explain it better.

    You need to clarify what the notice arrangements are.

    You cannot have PILON and be on garden leave as they are two different things.

    Garden leave is where you remain employed by the company and receive your wages in the normal way through the payroll system, subject to deductions for tax and NI, but you are not required to come into work.

    PILON is where the employer does not require you to work your notice, terminates your employment, and gives you a lump sum payment in lieu of notice (PILON) equivalent to the sum you would have earned, had you worked your notice.

    Whether you are entitled to the bonus depends on the rules of the scheme. But if the rules require you to have been employed for the full three month period, you would be entitled to the bonus in the first case, but not in the second case.

    TBH I am surprised that you have been put on garden leave as most employers would pay PILON unless they are dealing with a senior manager or director, in which case garden leave may well be the preferred option.

    well done - I have had to work my notice - now in week 6 and doing nothing much -apart from sorting myself out and doing courses - it is a complete waste of mine to be honest xx

    As above re: PILON,

    Check your start date and years of service for the redundacy.

    Does statutory notice take you over another year?

    ive done 11 years which was completed in march 2011.

    my concern is about the bonus scheme. Ive looked up our policy today regarding bonus and it states that if you leave due to redundancy its down to the business whether they pay any and it would be pro-rated for the number of days in the quarter you worked.

    My bone of contention is that I had all my duties taken off me - not through my choice, however did complete some activities which did add value to the business, so in my eyes i should still qualify for some bonus.

    The regional manager has told me some incorrect information as he said you have to work the complete quarter to qualify. This was infront of our site union official too.

    Ive asked for clarification about whether my employment is officially terminated as of 31st may as i was told I was on gardening leave
