We have recently been offered £150 back from HSBC after an initial claim for £223. Along with the offer came a seperate note.
"I am obliged to advise you that HSBC bank plc offshore is not governed by the UK Financial Ombudsman Services (FOS) and that FOS has no jurisdiction in the offshore islands of Jersey, Guernsey and the Isle of Man"
Am I best now to accept the offer, or can anyone advise whether different rules apply to the offshore banks and are they calling my bluff.
In addition, if I accept thier offer, I am also agreeing to make no further claims against the particular account number should any charges be claimed for in the future. Is this correct, or just another bluff?

I have enjoyed reading about all the claims won, but being in the Isle of Man, I have not heard of anyone doing it from here, If your an islander it would be encouraging to hear of anyone who has had successful claims.:;)

I'm new here - but have "lurked" for a while!
Having seen the info on reclaiming bank charges in Guernsey/Jersey/Isle of Man, there is a Guernsey and Jersey forum on https://www.penaltycharges.co.uk.
It appears that some Channel Island residents have to date been successful and there is one gentleman who posts, who works for a Jersey bank and is head of compliance, who is very helpful. He has successfully reclaimed his own charges from the Jersey bank using a UK address to issue proceedings.
I hope it is okay for me to provide this information on this site - the other one does mention moneysavingexpert so I'm sure you get referrals from there.
There is also a case due to be heard in UK tomorrow which may force a Court ruling on the issue and set a legal precedent (hope that's correct - I'm not a llawyer).
I have started my own claim against a Guernsey bank, by writing to their Head office in London. Have received the standard acknowledgement and their 8 weeks (when they have to let you have a reply by is next week). Took the decision not to issue proceedings yet (which may or may not be to my detriment).
Hope this helps and would be v. interested to here from other Guernsey residents if they have had successful claims. I am aware of one to date.0 -
does anybody know the deal with the Isle of Man Bank? It is an offshore branch of Natwest. Any help would be greatly appreciated.0

Just sent back acceptance letter re: my Guernsey bank account charges.
Wrote to bank HO just under 8 weeks ago. Acknowledgement received 7 days later. Then nothing..........but this week (just within the 8 week FSA deadline that banks have to investigate matters) received offer for over 80% of amount claimed.
Cost to me - 1/2 hour reconciling and preparing claim and typing letter plus c£3 charge for registered letter to Bank HO.
Interestingly by not forcing the bank to respond to threat of legal action claim has been settled more quickly that others that are now being given court dates as far away as August!
Well pleased with outcome, particularly as due to lack of relevant consumer legislation in Guernsey we thought money was gone forever!!0 -

Recieved an email from a colleague of mine, quite out of the blue, who lives on the Isle of Man, I am sure he wont mind me posting it here.
"A friend of ours at the top of Copse Hill put me onto this website (below). By following the simple steps I managed to get over £2100 back in bank charges (2x separate bank accounts).
It takes you through the complete process and even has preped letters to send to the bank.
I thought it was only fair to share this information with you.... (COS THATS THE TYPE OF GUY I AM!!)
If you are interested in applying to get your bank charges back, do it sooner rather than later as the banks are frantically trying to change their terms and conditions, but as you can imagine, this can't be done by them overnight.

Hi All, I grew up in Guernsey and have banked with Royal Bank of Scotland (Channel Islands) for the past 15 years. I estimate that I have been charged £1500 over the past 6 years and have requested statements in order to claim this back. Has anyone had any experience in claiming from channel island based banks? I’m worried that different laws apply there. Thanks in advance, Charlie0
