    I have today been informed by the Jersey CAB that they are now offering a Step by Step Guide for reclaiming bank charges in Jersey.
    Looking at it, it's pretty much the same the steps posted on here and other websites.

    The one thing they have not mentioned, and I am waiting to hear back from them on this, is what has changed in order to now allow reclaims in Jersey.

    I asked them this because the CAB 'step 4' involves threatening legal action, something that wasn't possible previously (because of the law - see previous post), so I'm wondering if this is an error on the CAB's part, a change in Jersey law, or whether you are meant to go through the English courts.

    Will let you know.
  • OK, have had a reply back from the CAB, as follows;

    The law has not changed in Jersey.
    The hope is that the Banks in Jersey would not want to defend a claim for refund of excessive bank charges in a Jersey Court in view of UK precedent.
    We will not know until somebody decides to bring an action.

    Looks like I could be the Guinea pig then!

    Either way, you now can, and you now should, apply to reclaim charges in Jersey. So get on with it.

    I live in Guernsey and after receiving a letter from Lloyds TSB that they would not refund my charges,I have now been in touch with FOS who are trying to sort this out for me.
    I will let everyone know how I get on.

  • I submitted two reclaim letters on Tuesday, one for my account with HSBC, one for a joint account with HSBC.
    I received a letter yesterday for one of the claims £2,401.50 offering me £1,150.00. (where the other claim's gone is anybody's guess)

    On the one hand, it's money that I thought had gone forever, on the other, it's not what I asked for.

    Do I set a precident by taking it further? I don't know, I'll think about it over the weekend.

    Regardless, it does show that you CAN reclaim charges in Jersey::beer:

    Less than half of what I asked for doesn't seem enough to me. Even though, by Jersey law, I'm not actually entitled to it.
    I don't really want to set a precident, but I do think I should push this further.

    Perhaps a letter, suggesting that I'm prepared to go all the way might be in order. Maybe ask for the details of their Legal representative?:confused:

    I am so glad to find this site and a Jersey thread.
    I am with HSBC and sent them an itemised list of charges totalling over three thousand pounds.
    This was sent over a month ago and I sent a reminder two weeks ago stating that if they didnt respond soon I would contact the Fair Play team at the J.E.P.
    So far I have had absolutely no response.
    All I have had is this months statement with a further £25 fee deducted.
    I am extremely angry at their arrogance and will be more than happy to see them in court.
    Does anybody know what my next step in Jersey should be.
    And no I do not mind being a guinea pig.

    That feels better...rant over.

    Take care that in fact the offer isn't for both accounts as has happened with other people when two claims go in together.

    I don't know what to suggest for the best to be honest especially when you may be the "guinea pig". £1150 is a lot of money when you consider you didn't think you would be able to claim any but not a great offer.

    Perhaps a letter to say how much you would accept?
  • I have an account with the Isle of Man bank and have just calculated charges from the last 6 years of just under £1000.... can I still claim these back even though the bank is offshore? Do the same rules apply? :confused: They are part of Natwest I think....

    I can tell you what steps I took if that's any help.
    I can also give you the name and address of the person who replied to me.
    Either one should get you a response. Should!
