If i write the letters to them to claim the money back will they close the account and demand my overdraft be repaid?

Maybe, no one can say for certain. You need to make plans in case they do.
p.s they said because i have already have one charge back this year i cant have any more

Ignore this, by the time you've filed a court claim it's very likely they will be eating their words.

Can i still claim them even when it is beneath the £12 threshold?

What £12 threshold? There is no such thing for bank accounts.

What you are thinking about is a level the OFT decided they will not take action against credit cards below.

Put your claim for the full amount.
  • I have just sent the first letter to HSBC requesting my statements has anyone had sucess with HSBC and at what stage did they settle?.Also i have just opened up a new account with a bank suggested by this site do i now close my account with HSBC as i have to have my wages paid into my new account to keep it open?.
    Any help would be grate
    Thanks
  • Aaahh - was looking in the wrong place! Can now view all my statements. Should I wait anyway for them to send them, or should I write and tell them that I have viewed them online and not to bother?

  • Can I also ask, what format will HSBC want to see the charges in? I have seen a spreadsheet mentioned in a few posts, is that something that is available on this site or have you guys just done your own thing?

    Thanks

It's up to you. The only reason for opening a new account is a for a fallback just in case your bank asks you to close your account once they've settled. Some banks do this and some dont. You can leave the account as it is unless your bank wants you to close it after your claim.

No need to wait if you have your statements. If you have written for them, they will send them anyway. You can go ahead now and move onto the next stage if you can see all your charges.

For the next couple of letters to the bank, you don't need to set out the charges in a spreadsheet. Here is an example of how set out the charges. I do this in a word document, and send the bank a copy with the next couple of requests. At the end of the document, I add up all the years to give the total.

  • I want to claim charges for both of our accounts, both of which are with HSBC. I have just calculated the charges on one account - £2716 or £3215.01 (They can keep the penny LOL) with the 8% interest added.

Am I right that to go through small claims the claim has to be lower than £5000? I will be calculating the charges on the other account later today, but I anticipate that together they will exceed £5000. Does this mean I have to go through the whole thing twice, or do I just go for the max. allowed through small claims?

    Thanks

  • Thank you for that link, however which is actually the best thing thing to do. At the end of the day anything that we get back is a bonus, and if it is around £5k but lower than what we have actually been charged, that would be fine. But I don't want the bank to think we are a soft touch by opting for less to go through small claims. Could it make a difference to the way they view our claim?
