Can someone please clarify to me what law it is that makes them illegal signs ?
I have seen this assertion many times but have yet to find the explanation of which law the sign falls foul of.
Yes ,I know a Private company can not enforce a penalty.
Yes I know the OFT would be concerned that they are misleading.
Yes I know the BPA tell their cronies (oops members) not to use this term.
But even though the sign is misleading ..is it actually "illegal" per se ??
They know they do not have the power to enforce a penalty, so are they "Making a false representation dishonestly, knowing that the representation was or might be untrue or misleading", contrary to the Fraud Act section 2?0 -

That is true they will invoice you for the charge.
The car park signs make no threats, fair enough the letters they will send may but that's a different matter.
Most supermarket car parks don't need this type of enforcement , my ASDA had it to deal with a specific problem ..but now
that the problem has ceased to be ..they don't have any PPC at all.
It is the over zealous and sometimes down right fraudlent activities of PPC's that have created the backlash.
There is nothing wrong with a landowner wishing to impose charges and conditions when allowing people to park .
Any decent person would acknowledge that the landowner should have a say in how their land is used and they should be able to have some method of deterring persistent transgressors.
Sadly PPC's have lost sight of that being their raison d'etre ..greed has not suprisingly taken over .
Whilst people continue to willingly part with ridiculous amounts like £100 for minor transgressions you can be sure the PPC's will milk it for all it is worth.0 -

It is illegal for a private individual to clamp a vehicle over a previous "debt" - I.E an unpaid private parking charge.Okay, I'm confused. You can not legally clamp a car for an unpaid parking INVOICE.
Action against a persons private property i.e. the car can only be taken by a court appointed balliff and this only happens if the debt is proven to be due by virtue of a County Court Judgement (CCJ) and if you don't pay what the Court directs AND if the claimant goes back to court to apply for a warrant of execution for a balliff.
Warrants are a last resort as courts prefer to use an attachment of earnings order to deduct payments from your wages. (And yes you do have to provide information to the court re your employment and earnings)
A private parking company can not clamp you for not paying their invoice and if they did the Police should definitely be called.
This is totally different to a clamper clamping your car in the first instance for an alleged parking contravention ..at the moment they can do that and extort money from you for removal of the clamp ..which is why parliament is debating a bill at present that will outlaw this modern day highway robbery (excuse the pun)0 -
