disgusting behavour at asda

i was at asda on forest town today, and a parking "ticket" was placed on my husbands car.

it was from Town and city, the code stated we were not displaying a disabled badge, however my badge was on the dash, and in fact the ticket was placed on the windscreen directly above my badge.

now i know these "tickets" are unenforable, but 5 or 6 other cars were also ticketed for the same reason, and all were displaying badges.

i couldn't find the parking attendant, so went into customer services, told them that i know the ticket is unenforcable, but found it disgusting that it had even been placed on our car while displaying a badge.

i tried to inform as many other customers as possible that were ticketed that they are unenforcable, and to come on this site if they didn't belive me


the customer services woman said if i didn't pay i would be clamped the next time we go there, i just replied tthat i would like to see them try


they have no signs saying clamping is in opperation, so i would really like to see them try clamping me :rotfl: :rotfl: :rotfl: :rotfl:

    Disgraceful response from the Asda store.
    A heavy-pencil complaint to head office is merited.
    Ignore Town & City.
  • As you can see its all about the money, no matter who pays. The ""customer"" service person needs retraining.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    .....and be made to smack her own ar** into the bargain in the well known Asda tradition.

    Not to mention the illegal T&C signs in Asda car-parks which use the words "civil penalty charge".

    Can someone please clarify to me what law it is that makes them illegal signs ?
    I have seen this assertion many times but have yet to find the explanation of which law the sign falls foul of.

    Yes ,I know a Private company can not enforce a penalty.

    Yes I know the OFT would be concerned that they are misleading.

    Yes I know the BPA tell their cronies (oops members) not to use this term.

    But even though the sign is misleading ..is it actually "illegal" per se ??

    Ok maybe but there again maybe not ..it is a misdescription but it is not a claim or demand for payment.

    I agree that any letters they send would likely breach this act if they use the term penalty.

    I suppose it all hangs on wether or not a court would view the use of the term penalty as a breach of Section 40 (3)

    "falsely represent themselves to be authorised in some official capacity to claim or enforce payment;"

    Maybe there is that implication in the use of the term "penalty" , but there again is does say civil (so not criminal) and it does also say charge (so not a fine).
