I am about to start my claim against A+L via my local court. I am doing this via my local court because MCOL will not take my debit card. I have the claim form but to make sure I get it all correct I need some help as to what to put in each part.

    CLAIMANT (this is me)
DEFENDANTS (is this A+L and to what address do I put in?)
BRIEF DETAILS OF CLAIM (what do I put in here?)
VALUE (do I put in the total with interest as 1 total or as 2 separate totals?)
PARTICULARS OF CLAIM (what goes in here)

    Many thanks

    SUCCESS
Finally reached a resolution of complaint with Alliance and Leicester by using FOS. As I'm in Scotland this was the best way to go for my particular claim due to Small Claims limit up here.

    CLAIMED - £1020-00
    REFUNDED - £1258-00

Initially claimed way back in December last year. Refusal after refusal from them was sent. Took case to Ombudsman at the end of May. Now received full and final refund plus interest, without admission of liability of course.

  • Hi jdallen, have a look on Martins step by step guide on taking the bank to court, it will answer all your questions and give you templates to use. If you need any further help post on this forum or have a quick look at consumeractiongroup.co.uk under the A&L forum and there is plenty of posts there. Good luck

    Hi,

This is my first post so hope it's in the right place!

I have received all the statements through, sent the initial letter requesting a refund to which I received the standard reply.

I then sent them the second letter stating that I still wanted the charges refunded. I have just received through an offer from A&L of £66 "in full and final settlement" on a claim of around £650.

Is there a further letter I should send stating that their offer is unacceptable and that I still want the full amount?

I only have until 15th July to respond so any help will be much appreciated!

    Thanks

    John

Well... was I relieved to read that someone else has got the exact same letter and being offered the exact same amount... £66 ... as me, I was recommended to continue after I had politely declined their offer (even the date to respond was the same as me).. and since I have received a letter telling me that I am entitled to absolutely nothing as my charges were incurred on a current account, and their charges are clearly laid down...

I posted a note the other day hoping that someone would get back to me advising me of the next move, but as yet nobody has... I am feeling like giving up, I am chasing for £577.. but wonder if its worth the hassle, the thought of court terrifies me!
Continue with the battle... don't let these folk off with this, after all they were quick enough in taking it off us...

If you need to do anything, the letter will tell you. What exactly does it say?
