I agree. How they can ever prove that the RK (who may not have been present when the car was parked) had agreed to the so-called contract, when they were never there to read the T&Cs posted up in the car-park.
What should have been included in that bill is legislation to stop PPCs and DCA being "economical with the truth". These include implying certain procedures (such as Norwich Pharma and "civil disclosure 3.16) can be used in the small claims court, that CCJs and bailiffs will materialise without the case going to court, and one I highlighted yesterday in the letters sticky, where a PPC is threatening to come to somebody's house and clamp their car because of an unpaid parking ticket.

What amuses me is the requirement for a ticket to be put on a car at the time. No-one seems to be kicking and screaming about that little gem yet it will mean the end of the road for ANPR on private land!
The whole thing is ridiculous, just needs a nice early Small Claim where the registered keeper points out to the judge that there's no contract with him/her as they weren't there.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

the demise of ANPR (private) isn't good news for the PPC's but I come over all warm at the thought of the £1000's 'invested' in these soon-to-be redundant gadgets.
I'm a bit iffy about RK liability, though. is it feasible that a judge could take the view 'be careful who you let drive yr car, sir'?

In criminal cases yes, but a civil case. I doubt it.
Let's suppose you lend a chain-saw to a friend and he injures a member of the public while cutting his hedge. That person then sues your friend for damages, but I doubt if they could sue the owner of the chain-saw.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
