    Breaking News ...... Evans Halshaw a load of robbing !!!!!!!s !! Refer them to the reply given in Arkell v Pressdram :D

    Tell them that if they are that uncertain of the provenance of the vehicles they are selling then you will shop elsewhere. If you carefully read the contract you are signing, standard amongst all major motor traders, it will state that all checks are clear. They are trying to get you to pay for their protection.
  • If you buy privately and there is finance on the car the car doesnt belong to you and your stuffed.

    If you buy from a garage (or any company) and there is outstanding finance the car belongs to you and the garage is the one who will be chased to settle not you.

    It sounds like a complete con to me.
  • Hmm - I have just bought a 2 year old Honda Jazz from Honda main dealer. They tried to charge £74 for an HPI check - the car was a demonstrator! Plus another £75 transaction fee - (part ex and cash). I queried them both and they were waived. I wonder how many people just pay charges like that without question? Obviously it would have needed the former if it had previously been owned by anyone other than the dealership but I would then have said I would get it myself.

    This. As a dealership, it's in their interest to do the check and ensure a car is clear of finance or Cat status.

    You should pay nothing for this.

    Tell them to go and do one.

    I'm sure the OFT would like an official complaint made about this. As professional traders they have to carry out checks (part of their overhead, not yours) and they are expressly not allowed to invent charges like this at the point of sale that you were not aware of. They must have either balls of steel or the best defence lawyers in the country.
  • All cars are HPI checked when they take them in, rather than charge the person who part ex'd the car, they charge the new buyer. Alot of the time it's itemised seperately on the invoice, but generally it's usually included in the price. I know at Saab they used to 'waive' the fee, but as it didn't appear on the invoice anyway it just made them look good.

    If it's ontop of the agreed price and not included i would refuse it and walk away, or make them waive it.

    It's also very rare they give the customer the HPI paperwork anyway.
    This thread has me so pumped, I headbutted my dog and we both screamed.
  • Well a quick update for you all. The garage called this morning to see whether I wanted to go ahead with the deal. I said only if the car was reduce by £98 to cover the 'Vechicle Service Check.' I didn't need to go into to much detail and they called back moments later to say that was fine. Obviously an added extra for them. I'm really pleased with the price for my new car. Just need to check it out when it arrives as its getting deliveried (for a charge of £100) shortly.
  • As with most large dealerships the Sticker price on used cars is the price they are asking for the physical car. (they used to put small red stickers on advising of the additional 'OTR' charges).

    When you are made an offer you will then find that they add on RFL, Admin Fee, Extended Warranty, Protection Pack, Tyre Insurance, GAP Insurance etc etc.

    These all pass the charge onto the customer protecting profits and with the exception of RFL they all have a profit margin and therefore actually increase profit on the sale and money in the salesmans pocket.

    The sticker price is their Invitation to treat and forms no contractual obligation, what then happens in the negotiation phase is up to you. Obviously the dealer will put the price up as much as poss, and you will hopefully do the opposite.
    Obviously FT would take a dim view if they repeatedly mislead customers but I really doubt they would give a monkeys about the admin fee (which is like i say is probably covered in the T+C's somewhere).

    That said all of these are negotiable and you can elect not to have them.

    If all you want is the car at the advertised price including mats, RFL, a HPI and some pink furry dice. Just tell them it's not difficult as the OP has discovered. Worse they can ever say is no.

    I negotiated a good deal on a car from EH a couple of years ago but they then added the HPI check price on, I wasnt happy but I paid it and then got free delivery from Scotland to Norfolk
  • Hi All,
    I bought the car from Evans Halshaw about 5 month ago and did pay £98 HPI Checks (they said it is additional insurance for you). They didn’t sent me any HPI Checks about 2.5 moths (it was promised they will send it to me every month) until I reminded them about their promise and money I paid. Apparently, they didn’t check my car during these 2.5 months.
    When I got HPI Check report from them, it was a warning that my car is on Finance. I asked salesman to explain it. He said that all cars they sell are on Finance until it is sold. Then, they call to the Finance company and ‘clear’ the car. So, after 2.5 Month he called to the Finance company and asked them to ‘clear’ my car since it is sold. Finance company send a fax to Evans Halshaw to confirm that they ‘have no further interest’ in my car. And as it was explained to me – after this ‘clearance’ my HPI Checks Report will be fine. A month later I got HPI Checks report … with the same warning!
    Well, I asked Evans Halshaw to sort this problem out … and they said something like – we have a fax from Finance company that they ‘have no further interest’, we don’t know why HPI Checks Report shows a Finance warning and it is not our problem anymore and we make you a favour when we talk to you about this …
    Any suggestions of how to resolve this situation?
