Help Needed.vibe Fm Win A Phone For A Year

I also won a phone from Vibe, and my contract started on 3rd August. I've never received any payments from Only Communications. I also saw the article in yesterdays EDP, and contacted T-Mobile via 150 to inform them I was affected by this. They kindly offered me half price line rental for the remainder of the contract, but i have declined the offer at the moment as I have just submitted a claim against OC via the Small Claims court earlier in the week... don't want to be blamed for breaking my side of the contract just in case it does all work out.

One thing I can't remember though, is ever signing a contract with T-Mobile. Can anyone else?? I remember having an A4 piece of paper from OC, on which I had to put my address, bank account details and choice of phone, but can't remember ever filling anything else in.

Also, would anyone be able to e-mail (or even better, send a copy through the post) me any correspondence they received from OC showing the terms and conditions? I know they did have this on their website, but i foolishly never copied it down, and the site appears to be no more! :mad:

I'll keep you posted on how the court claim goes, but would appreciate any comments from others too

Person i spoke to at kiss told me that their director paid a visit to only communications cambridge office the other day. Guess what - the office is empty, and has been for over a week according to the caretaker. The website is down, they dont answer the phones, and i quess we can assume that onlycommunications are no more.

Have since found out that a similar scam was run last year. The phone company gives these phone prizes then vanishes, only to set up the following year under a new name.

Kiss are still trying to get refunds for those of us who have made payments and not got a refund. they have been in touch with offcom, trading standards and are thinking of going to the fraud squad over this.

Please dont blame the radio stations, they are trying to help us ( at least vibe/kiss have been helpfull and kept me up to date)

tmobile are not accepting any responability for this, but are offering a 50% reduction on the remainder of the contract as a goodwill gesture. I cant see this as a problem to be honest as only communications have already broken the terms of their contract with me by not refunding the monthly charges.

Interesting point. I do remember signing a tmobile contract and sending it off to onlycommunications before i got my phone, but there was never a signed contract between me and onlycommunicatios for the refunds; only a terms of the competition sheet.

i will update as i find out more from vibe/kiss

As for the change of address however, OnlyCommunications did replace their Cambridge address with one in Milton Keynes a few weeks ago as thats the address I used to serve my court thing to.

Maybe it could be worth trying to contact Onlycommunications US office if they really do have one, they might be able to shed a little light on the matter

Be good if Vibe/Kiss can sort something out about the refunds we never got though

Hmm, just been having a search about using a few tools i use for work. Looks like Only Communications registered legal address is:Springvale, Police Station Square, Mildenhall, Suffolk, IP28 7ER. Apparantly, they only registered as a Ltd company on 28/06/2006. Like you say terry, looks like this is probably something they do every year under differant names, can't trace them having offices in any overseas countries! Trying to trace down some details on the some of the company executives behind Only Communications, try to get a better idea of who we're dealing with!

Having never entered a radio comp before, I was also sucked into this scam.
Rang T-Mobile to get a reduction in monthly payments, but manage to get out of the contract all together. Could not praise T-Mobile enough, who were very helpful. I have a copy of the T&C's from the comp if anyone wants them.
I only recieved one payment from OC by cheque. They still owe me £105 but cant see me getting that from them as they are not answering the phone and now their web site is not working.
Going to ring Kiss on Monday to see if they will reimburse me.

I would love to know exactly what you said to t-mobile to get them to release you from your contract. I have tried twice now, and the best they will offer is a 50% reduction in the monthly fee.

Anyone else been able to get out of thier contract?

I said to T-Mobile I wanted to get out of the contract, at first they offord me 50%, I rejected that, they then offord me 100%, so I just paid for what I used. I rejected this too. I kept on saying I really wanted to get out of the contract as I dont use the phone much as I have a works phone.

I haven't been affected by this but I would take the following approach in a situation like this if I could.

1) Negotiate Max goodwill gesture from T Mobile in writing to their CEO
2) If this still leaves you out of pocket explain that you would be happy to accept their offer on account and hope that you could persuade them to increase it
3) If 2 above applies, camp on KISSs doorstop for the remainder explaining that you have gone to extremel lengths to reduce your loss and hence they would be able to recompense you at a lower cost to save their publicity.

I have only just read this thread again.....I wish you had all pmd me but anyway, here goes my story.

Kiss have been most unhelpful even though trading standards say that they are liable.

Dont hold your breath for a return call from you know who at kiss (its a she)

I to was offered 50% off and no reimbursement of the £105 I am owed by T mobile, I refused and they then offered to cancel the contract with no extra charges..I accepted.

I Rang Kiss again to try for the £105...they dont want to know.

One person on here did pm me and with her help I got back to T mobile,s directors office and spoke to a very nice lady who reinstated my contract for free and nothing to pay for the remainder of the term and will reimburse me the £105 ( i am still waiting).

She also told me Onlycommunicatios have ceased trading but they are in talks with a sister company .. she also told me that Kiss have refused to accept any responsibility

pm me for the name and number of the directors office.

I have stopped listening to Kiss as I feel they should have been the ones to offer to reimburse and not T mobile who didnt know anything about the competion until..Kiss told us to ring them.

hi have tried to pm you photome but you have too many messages i too would like the name and number of who you spoke to at t mobile about reimbursment. i have already got my contract down to a 100% discount i just now need the £105 i am out of pocket.
