If you can't see that, then I am truly sorry for you.
Bear in mind that a T is obliged to inform their LL of matters affecting the property *in writing* so that the LL can organise repairs: it is part and parcel of behaving in a tenant-like manner. The T does not need you to physically turn up every month to facilitate that.
Tenant is granted exclusive occupation of the property under that AST. There are two implied covenants in play here - one refers to the LLs right to inspect so that he may comply with his s11 repairing obligations and the other states that the T is entitled to "quiet enjoyment" of the property, ie to live there without undue interference from the LL.
You may write whatever clause you like into your tenancy agreement but that does not mean that it will stand.
Should your T refuse access to you, then your only options would be to pursue a court order and/or serve a S21 to evict after expiry of the Fixed Term.
I'm thinking that James_N is perhaps a very amateur LL. Monthly inspections are quite simply the sign of a LL on a power game.0 -
My property is inspected monthly by my letting agent. And no, there is no fat fee involved. it's a business. If the tenant doesn't like it, don't sign the contract. I "inspect" the property I live in continually.
There are enough landlords who don't give a damn, and tenants on here whining about that. Where a landlord does want to keep the property in a good way (and the tenant happy), other tenants whine.
Sometimes it seems to me tenants are a whole lot of trouble as a class of people. They don't want any responsibility, want everything their way, but are quick to demand their "rights" when things go wrong.
It's kind of irrelevant that you " continually inspect the property" in which you actually live: the T has an AST and is entitled to view your rental property as their home. If you can't get your head around that it may be best for you to sell up and buy a little shop somewhere where you can be king of the vegetables or whatever.
You are absolutely right that property letting is a business and, if you want to be successful at it, you have to understand that it's a "people" business.
Tenants are not a homogeneous "class of people" - perhaps your limited experience of property letting has led you to think otherwise. People from all walks of life rent property, for different reasons, and the majority take their responsibilities as Ts seriously.
Tenants who raise concerns about repairs issues are not "whining" unless we can also count this post of your from another thread as a good old "whine" too?At the beginning of the month, our tenant informed us by phone he was leaving on the 29th December. No written notice has been given. I am not confident about these tenants, so we have counter-issued a section 21 giving 2 months notice.
If he does leave, how can I be sure he's really gone with nothing in writing. he could pop up again and claim I'd put him out by changing the locks. if i don't secure the house, we could get squatters.
What about utilities, council tax, damage while it's empty (pipes). Apart from the section 21 how else can i protect myself against false claims by him? What about the oral notice, issued at the wrong time of the month. it's a periodic tenancy.
And, yes folks , JN does appear to be an amateur LL.......0 -

It's because I take it seriously that I get it right most of the time, with thanks from the tenant. And because it's a business, sometimes there are problems, which I rectify correctly.
It may interest you to know that it's my LETTING COMPANY that inspects once a month. A professional outfit that looks after my and other landlords' interests. That must be quite a few monthly inspections in that location - which I shan't identify here. As a professional company, I trust them to get it right.
The other property is closer to home - where I haven't inspected regularly. I wish I had - it would have rooted out that bad apple sooner.
