Help! Hit by Uninsured Driver etc etc

  • Quick Update, again thanks for the info and help etc.

    I have had to raise the profile of this case because of so many important different developments that have occurred in the last several months.

    1) Letter from CPS "...After the man failed to attend Court, we lost your file and we forgot about section 1 of the Magistrates Court Act 1980, we forgot to tell the Thames Valley Police to arrest the man..."

    2) Six Months has passed, CPS say "...The offences the man committed are time limited, six months has passed therefore we can no longer convict him.."
    3) Thames Valley Police and I mutually accept they are not responsible so complaint to the IPCC ends.
    4) Alok Sharma MP for Reading informed and writes to Head of CPS for Thames Valley and Chilterns, also contacts Kenneth Clarke.
    5) Radio BBC Berkshire interview me twice and ask for the opinion of the CEO of the Motor Insurance Bureau.
    6) BBC South Today interview me about the case. bbc.co.uk/news/uk-england-berkshire-14930539
    7) A second response from the CPS is received saying they have taken steps to prevent this from happening again, informed all practitioners of section 1 of the MCA1980 and improved administration so a case file cannot go missing again (yeah right).
    8) Alok Sharma MP to present this case to the Commons Justice Committee in October.
    9) I ask myself this question. Can I sue the CPS for negligence for allowing a miscarriage of justice to occur? For nothing more than to teach the CPS an important lesson, force a formal internal inquiry and possibly disciplinary action against personnel and to receive additional compensation to pay for much needed rehab therapy on my back, shoulder and neck which are still causing me significant pain after nine months.

    Had he been a hard working citizen, who simply let his insurance renewal run over, they'd have hung drawn and quartered him..... :mad:

    Unfortunately the cps are useless, and they regularly lose case papers (Either all of the file or bits of it)

    Maybe I’m missing something here but why aren’t you claiming from the MIB?

    Yeah, claiming from the MIB for all losses, but wondering about sueing the CPS for breaching Section One of the Magistrates Court Act 1980 which subsequently meant this man could be at liberty with no record of the offences he committed.

    Did you see in the Metro today, the MIB have just gained authorisation to pursue Pete Docherty and / or the uninsured driver of his car who he allowed to drive his car. He had an accident causing severe brain damage, the Metro mentioned they will be looking to recover hundreds of thousands of pounds
