Before the event legal expenses insurance isn't anything to do with the misnamed "legal cover" offered by motor insurers for around £20!

Interesting point, how does that work when the standard practice these days seems for insurance companies to pass you straight on to a credit hire/claims handling firm whilst pocketing the referral fee?
The only difference between what you and Quentin are advising seems to be who gets the referral fee, the insurance company or the punter
What tends to happen is that the insurers pass your details on to a credit hire company to get you a car.
They also pass your details on to the BTE insurers and/or the nominated solicitors to handle the claim under the policy at no outlay to you. BTE insurers have ongoing agreements with a panel of firms, and normally some pretty stringent service level agreements.
The credit hire company will sell your details to the claims management company who they are in bed with irrespective of the fact that you don't need their services. The claims management company will then contact you and try to convince you that rather than using the legal expenses insurance you have already paid £20 for which will entitle you to full legal representation at no extra cost you should actually let them set you up with their tame no win no fee merchants. The no win no fee firm and the claims management company will then sell you an ATE policy that you don't need for £2000 and a loan to pay the premium. If you do this you could risk being unable to recover the £2000 premium because TP insurers will say that you have acted unreasonably in failing to make use of the BTE cover you had in place.0 -

No agenda. I don't deal with claimant PI work.
You are legally obliged to utilise BTE cover if you have it. The case is Sarwar -v- Alam.
Anyway this is getting off topic.0 -
If the other driver gets convicted for this you should be able to claim un-insured losses either from him or the Criminal Compensation Board (or what ever its called nowdays).
Now called CICA and just the same as when it was the CICB there is almost certainly no claimInjuries caused by motor accidents are not qualified for claims unless the vehicle was intentionally used to cause injury0 -

Hi, I have read with interest and utter confusion the comments here and do appreciate all constructive advice. Here is an update on the situation.
1) Loan car provided for several weeks at no cost.
2) Insurance company paid out for a replacement car.
3) Referred to Physiotherapy for injuries, nothing she can do
4) Referred to Accident Claims Consultant, wrote crap report and has been challenged.
5) Letter from Insurance Solicitors telling us other party has no insurance. (Duh!)
6) Letter from Insurance Solicitors telling us other party is untraceable.
7) Contacted Police Collision Investigation Unit - Wont discuss active investigation, even with victim!!!!!!
8) Letter to Chief Constable asking why I have not been referred to Victim Support Services or given information.
9) Traced other party on Facebook and blog indicates he has left the Country.
I have to fill out a form for the MIB claim, I am currently on a 16 week waiting list for surgery on my back as a result of the accident so am extremely frustrated by the whole thing.0 -

Unforunatly, the individual is built like a brick toilet house judging by his Facebook profile pictures and I would rather steer clear of having too much contact with him in case it could jepordise any Police inquiry - you never know the Police might even talk to me again one day soon over this matter?0

They might indeed but I wouldn’t hold your breath
That aside, as I mentioned in post #16, I’m pretty sure that as you’ve claimed on your insurance and they have has paid out for the hire car and the write off value of yours I don’t think you can’t then re-claim those costs from the MIB so good bye NCB and hello fault claim loading for the next 3/5 years.
On the brighter side, you can claim from the MIB for the injuries together with any other uninsured costs you have incurred like loss of wages, excess on your claim with your insurance, any other out of pocket expenses etc.0
