Help! Hit by Uninsured Driver etc etc

Hi All,

Newbie here looking for some help and support.
Last Tuesday was driving minding my own biz after shopping when going up a road a car drove out of a give way junction with no attempt to stop at all and collided with the side of my car spinning it 180degrees into on coming traffic and finally hitting two parked cars.

To summarize the nonescence...

1) Driver tried to drive off after incident
2) Driver refused to exchange details with me
3) Police called and attended
4) Driver has no insurance
5) Driver produced bill of sale for car for that day (Scam?)
6) Car conviscated for testing (?)
7) Driver tried to leave scene of accident by foot
8) Question marks if car is taxed/ tested/ roadworthy
9) I was taken away in an ambulance with shock and spinal injuries
10) Car recovered and quote for repair exceeds 50% of cars value
11) 6ish witnesses provided excellent statements indicating driver was at fault.

I have been referred to the MIB as the insurance company seem uninterested and to top it off the two cars I hit are claiming (rightfully) against me for the damage caused by the uninsured driver.

I have a courtesy car now which was delivered after I hit my head against a number of walls and pulled out all my teeth and having been told that I wouldnt be getting a car!!!!???

What happens now, I have never been involved in such an incident?

Thanks

J

Who has supplied your courtesy car?

You can make a claim for your PI etc via MIB - a claim handler will be able to help you over this.

No advice sorry, but I was surprised that the other cars you hit are able to claim off your insurance!

At a guess your insurance will pay for your repairs (unless you are third party) and you will claim via the MIB for your injuries.
  • If you are insured fully comprehensively then your insurers will deal with your claim for damage to your vehicle. Your insurance company will also deal with the claims from the vehicles you hit.

That just leaves your personal injury and uninsured losses, these claims are met by the Motor Insurance Bureau (this body is funded by all insurers to help victims of uninsured drivers). The MIB have very strict criteria for reporting to them so it is important that you get professional legal advice urgently. The action required will depend upon whether the driver of the at fault vehicle has been identified or whether he fled the scene or gave incorrect details.

You probably have legal cover on your car insurance, ask your insurer to refer you to the solicitors they use for the legal expenses insurance. If you don't have legal cover on your motor insurance check your household policy. If you still can't find cover then check any membership organisations you are in such as unions, breakdown organisations, sports societies etc. If you still can't find cover then you will need to approach a solicitor direct, if you post the area in which you live I will check the legal 500 for the top firms in your area. :)

Your insurance will deal with any claims against you plus your damage(s) if you are fully comp. I assume you have been given a crime ref from the police and possibly a report. Your insurers will need that. If the other driver gets convicted for this you should be able to claim un-insured losses either from him or the Criminal Compensation Board (or what ever its called nowdays). I would be finding out as much as I can from the police.
    PLEASE NOTE

Where's the crime? You mean a collision number.

Criminal injuries? I think not, MIB as others have said.

When I last checked, these are criminal offences.

Not recordable crimes so no crime number, stick to what you know.;)
