TBH strawberrie LTAHAW (living together as husband and wife) is a complex case and sometimes hard to prove, there is no number of set nights etc.

Not just IS - if she's claiming tax credits as a single person when she has a "partner" living with her then that's fraud. Whether he'd be classed as a "partner" for tax credits purposes is unclear though.
So what if he stays so many times a week. It not fraud, simple as that!! Even if it was to be investigated, it would be extremely difficult for HMRC to prove that “they are living together as man & wife” (that’s how it is interpreted in the regulations even if they are not married, before anyone say’s they are not married) because he owns a home and pay’s council tax on another home.0 -
Basically it is important that you show that (if anyone were to be investigated) although you both live in the same house, you maintain separate households. A separate house hold may exist for example, if there are:
- Independent arrangements for storing and cooking food
- Independent financial arrangements
- No evidence of family life, or
- Separate commitments for housing costs, even if the liability is to another person in the same premises.
You cannot be a member of more that one household at the same time. If two people can be shown to be maintaining separate homes, they cannot be said to be sharing the same household.

I was responding to the point that some people were saying it doesn't matter unless she claims IS. It matters just as much in tax credits as it does for IS.0
