    I wouldn't have thought it was any of your business whether she has her partner to stay over her own house. If she is working and not reliant on any means tested benefits, ie IS etc, then TCO won't be much interested especially if he has his own place and paying his own way.

    TCO certainly will be interested if she has a "partner" but is claiming tax credits as a single parent. Just as interested as the DWP would be if she was claiming benefits.

    TBH strawberrie LTAHAW (living together as husband and wife) is a complex case and sometimes hard to prove, there is no number of set nights etc.

    Hopefully it will help. Child support payments wouldn't be affected either way I'm afraid. WTC and Council tax benefit ;) are a different kettle of fish.

  • Basically it is important that you show that (if anyone were to be investigated) although you both live in the same house, you maintain separate households. A separate house hold may exist for example, if there are:
    • Independent arrangements for storing and cooking food
    • Independent financial arrangements
    • No evidence of family life, or
    • Separate commitments for housing costs, even if the liability is to another person in the same premises.

    You cannot be a member of more that one household at the same time. If two people can be shown to be maintaining separate homes, they cannot be said to be sharing the same household.

    Nothing whatsoever to do with the fact that the person could be committing fraud. If the OP hadn't said she was the NRPP I wonder if she would have been treated differently, some how I think so!

    I was responding to the point that some people were saying it doesn't matter unless she claims IS. It matters just as much in tax credits as it does for IS.
