Is His Ex Committing Fraud (CSA/Family Tax?)

Hi there! We would really appreciate some advice on CSA/Family Tax Credits

My fiance and his ex share custody of their children. She is the claimant for the Working Family Tax credit. We believe she now has her new partner staying in the house 5 nights a week out of 7 but she has not told the CSA/Family Tax Credits.

As far as we are aware, the partner is not paying to stay or giving her money. He also has his own home where he pays a mortgage and council tax.

Does anyone know if this would be considered fraudulent? We have tried to call Family Tax Credits line but are cut off as they are busy!!

The number of nights are irrelevant.

If he's not paying to stay or giving her money what bit do you think would be fraudulent?

It would only be fraud if he was staying there permanently and had no home of his own and she hadnt informed the relevent departments.
  • I thought maybe she had to declare the number of adults living in the home on her Family Tax Credit Forms?

If she is claiming means tested benefits it might be a different matter.

Maintaining a common household? Living together as husband and wife?

Or just the fact that she hasn't (apparently) told HMRC - if it wasn't fraudulent, why woudln't she have told them?

Him not paying is not relevant either. However it's a pretty complex area.
