    I think you misunderstood me. It appears that the deliveries are done by a small local delivery business. It may not be a limited company, but the fact that you were asked to pay them shows that it is a business. So if had refused to pay the driver, then it would be the delivery business that wouldn't get paid, and not the retailer. If you had paid the full £300, then I suspect that the store would have just paid the driver the same £20.

    If the store only sold one bed every few days, then they would have gone bust long ago. So I should think they sell a few per day. This would be enough to keep a man with a van in business at £20 per delivery.

    Is this the mattress, because it doesn't contain latex, it contains reflex foam encapsulated pocket springs, with a layer of memory foam.     OK fair enough. I can't be bothered talking about the same little details any more.

    That's not the mattress. The outside of it is very lush and deep, almost velvety, and it has circular patterns all over it. You totally sink into it and it feels a bit like memory foam. I can't wait to sleep in it tonight and not have a sore back...my old mattress was over 20 years old!

    Savoy 1000 Pocket Latex
    -Luxury cotton velour ticking
    -microquilted
    -two rows hand side stitched border
    -extra thick foam support layer
    -contains wool, silk and cashmere

    I cant find it on google and I can't post links anyway :(

    You were told your rights in post #2.

    You have agreed a contract. You have the right to re-open negotiations with the seller, but they have no obligation to change the contract that you have both agreed to.


    Sorry that's a bit blunt, but you did specifically ask about rights.

    No, but I am on a MONEY SAVING website posting on a FORUM! I didn't tell the seller that information, I'm explaining to people why I'm so bothered about saving another tenner.
    Can people stop picking apart my posts now and realise that this happened this morning so it doesn't matter anymore, I have said twice I decided to pay the money and have already paid it, there is no more reason to point out every little detail you disagree with in my posts? Jeez. Wish I knew how to delete a thread.

    Its been a while since i've been on here (such are the demands of life) so excuse me if i make any mistakes here.

    First, even if advertised on the website, it is purely a "invitation to treat". Therefore not legally binding - especially if its not agreed as part of the "contract".

    However what i would say is i find it strange the customer should be paying the delivery service and that the retailer says its "nothing to do with him". If its nothing to do with him then it shouldnt matter how the customer gets the matress home.

    On a further note, statutory rights cannot be contracted out of. This means that while you may not be able to claim under warranty, SOGA would cover you for not fit for purpose/faulty/damaged goods.

    Personally, if this was me and it was 2 mins down the road, I would pop in and say I think you've made a mistake, it says on your website delivery is free. Please can you confirm as I don't think I should be paying anything. If they then say, yes but that is only available on full price beds, we agreed a charge because you got a discount you have your answer. If you don't ask you don't get.

    Not if you damaged the goods transporting them home yourself.

    I would've thought that was a given to anyone with half a brain seeing as SOGA isnt intended as "accidental damage" cover.

    However I do know one person who i used to work with that purposely damaged an item in order to return it under SOGA. He dropped it down the stairs (dvd player if memory serves) and told them it was like that when he opened the box.
