So I should just pay the money, lose out on a tenner (bearing in mind I am SKINT, already in debt, couldn't afford the bed anyway, can't even afford to eat right now, trying to spend as little money as possible...) because I didn't know before I agreed a £10 delivery charge that they do free delivery?
I have decided I am going to pay the money. If I have any problems with the frame or mattress and need to return them or honour my guarantee, and I haven't paid the delivery charge, I'll have shot myself in the foot.
However, I came on this forum to find out my rights and I really wish someone could help me out because I don't know where to look for this information!
Anyway thanks for all the comments etc they have helpedeven if I disagree, it's always good to get other thoughts and opinions so I'm not only seeing it from my point of view. So thanks people

As the seller is so close why don't you go in there first thing and talk about the web site statement.0

On the website it states the followingWe offer free delivery within the local area on all bedsThis is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

Freddie will summarise for the needy.
OP goes into bed shop and gets massive 50% discount and has to pay £10 for delivery. OP then comes home and finds out that the website offers free delivery.
She wants refund from shop, not covered by SOGAs, and now wishes to purchase from website. Mattress on website is more expensive.
Freddie's solution. Go to the doctor and get arms shortened or take some sleeping tablets and lie on sofa for a night, then take time to look round before releasing wads of dosh from purse.0 -
as i said above the deal on the website is not the same deal you negotiated seperately and you're better off so i see no grounds for demanding free delivery.....
Sorry Toffe, but I'm not sure what your point is? On the website, (http://www.straitonbedcompanyltd.co.uk/) the free delivery offer states, "We offer free delivery within the local area on all beds and same day delivery can usually be arranged if required." The option of free delivery is not attached to any offer.
If they offer free delivery, then it sounds like the salesman, who must know that delivery is offered free on the website, was trying it on to get a few extra quid out of you and £150 for a mattress doesn't sound like much of a bargain to me, pretty much the average price for an average mattress!
It says "We offer free delivery", which I'm sure the OP would have been offered free delivery if they had paid the full £300. If they had paid £300 then the retailer would have paid the delivery company £20, and so they would be getting £280 for the mattress. To be honest the salesman was stupid to knock half off the price straight away. If he had said you can have it for £170, then you would probably still have bought it, wouldn't you?
Out of interest what is the make and model of the mattress?0 -
What it says on the website is irrelevant, OP purchased in the shop.0

Actually it isn't, because the web site is just an advert, as you can't buy through it.
However it says they offer free delivery on all beds, which I'm sure they will if you pay full price. But the OP only bought a mattress, and not a bed. And they diddn't pay full price, so they probably wouldn't have been offered free delivery on the offer price.0 -
.
I don't want to argue with you. Sorry. I came here to find out what my rights were about refusing to pay since they do free delivery.
Sorry about the misundersanding :undecided[/QUOTE
no problem but as i have already said you have no right to receive anything for free.
however it came about you agreed to pay a delivery charge so the free delivery was not offered as part of your deal.
again, as i have already stated, nothing stopping you asking for it though since it is mentioned on the website but if your looking for a piece of consumer legislation which entitles you not to pay for delivery here it doesn't exist. simple.
unless anyone can prove me wrong and i'll eat my words, so far no one has offered any links though have they?......"A wise man once told me don't argue with fools because people from a distance can't tell who is who"........0 -
Freddie... - I didn't pay £10 for delivery in the shop.
I didn't want a refund, I wanted to know if I had the right the refuse to pay. They can't refund me when I haven't paid. You cannot buy from their website. What they say on the website is very relevant because it only refers to buying from their shop. Check out their website if you want. Thanks for making a first time poster feel so welcome by being so sarcastic, maybe next time you should read it properly before summarising for me?
Tim - The 'delivery company' is actually 'the boys with the van', not a company but just some mates he has who help it out (the store must sell about one bed every few days so I doubt he is going to need a delivery courier - they go to the shop and pick it up and drop it off, it's not like you order it or anything...) and the person who sold me the mattress even told me 'payment has nothing to do with me, you pay them when they arrive.' Which explained in post 9. So he isn't paying for delivery out of the money I paid for everything as far as I can work out. He has the money I paid him. I pay extra on top of that for delivery. It is a Savoy 1000 pocket sprung double mattress. (latex and foam apparantly?)
So I said in post 23 I was going to pay the money anyway. They delivered it this morning, I paid the money with grace, didn't say a thing...did however finally get the right phone number since they phoned from the shop to say they were coming...I asked why there was no receipt of guarantee or warranty and why there was no instructions in the box for the frame and he said it'll all be fine.
So thanks to all the people who posted and tried to help me out, I have thanked all your posts and I'm not adding anything else to this because it's all done with now. CheersSealed Pot Challenge Member Number 1265 - No idea how much is in my terramundi pot so far from October 2010 but it's heavy!0
