Is Council Tax open to "Invitation to treat"?

    A soapbox ok.. Anyway what have you got to say about Council Tax, I take it you pay Council Tax quite willingly?

    I dislike paying any taxes especially fuel duty and VAT, more especially VAT. If I need work doing in my house which I can't do myself why should I give the government 20% of the bill?

    Taxpaying is backed up by legislation. If a tax is determined (determined, not thought or believed) "unlawful" the law would be changed so that it would not be. If popular pressure persuades a government to scrap a particular form of taxation, it will only introduce another to replace it, viz. domestic rates then community charge (poll tax) then council tax; or increase other taxes to compensate.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    You quote that implying that it is a court case where he represented someone, presumably successfully. The truth is somewhat different, quotes from his own website...

    Or you could just sit back like you probably will and continue to be one of the shepple.

    Once the order is issued then , assuming he doesn't pay, the next course of action is likely to be a bailiff and then potential bankruptcy action. Ultimately committal to prison may be undertaken - if if gets to this stage the magistrates will look at willingness (or lack of) to pay.

    The Council Tax (Administration & Enforcement) regulations 1992 are the better ones to read (from around reg 40 onwards) as they outline the enforcement options available and what happens if you dont pay.

    Courts don't issue liability orders, councils have been issuing them themselves. Councils hire courts for the day to make things look official.

    Courts don't issue liability orders, councils have been issuing them themselves
    A council cannot issue the Liability Order - the Liability Order is granted by the court after the issuing of the summons, no council issues the liability orders themselves. The Summons are often printed and posted by the council on behalf of the court but its the court who issue the summons, the counil merely print and post them for the court.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Anyway CIS, Has anyone within the catchment area of the local authority you work for refused to pay council tax on the basis of what we are talking about.

    I am also surprised at the amount of Councils that have CCJ's against them.

    Have you ever looked into the local authority you work for to see how many CCJ's if any have ever been issued?

    Authority should always be questioned, as should the beliefs, motives and actions of those who challenge authority and want to impose their will on others.

    Any order by a court must have the court stamp and be sign by the presiding magistrate, they aren't, because courts don't issue them, councils do.
