Go back and speak to someone else at the store, I would advise not involving HO unless you really need to and its a substantial r&r. Otherwise a substantial r&r may turn up and HO will already have your details and not be as willing to help.0 -

Quite common for release dates to be "broken" .... it only takes one high street store to break official release date and then the floodgates are opened. But the initial breakers are fined £50,000 and can be denied supplies for future releases by the producers!
But big stores, that don't specialise in games (e.g. Tesco, Woolies) often break it. Probably because they can absorb the fine easily, and hope to get people in store to buy the game, leading to the purchase of other goods too, offsetting the cost of £50,000 .... which is also very little to consider when that fine is for 2000+ stores .... unlike a small retailer who is unlikely to be able to offset this fine. Plus .... they are too busy to take full care and attention I guess too .... busy shelf stackers just get orders to stack the goods as they come in overnight, and they do .... often the stock is received a good few days ahead of official release date. (all the above being my guess, nothing gospel)
This happened for Pro Evo 6 for example very recently - it is usually the big titles, and Gears of War is the biggest yet on the 360.
I know for a fact that at least one Blockbuster and one Choices (rental company) store have started selling the games, but not as far as I know as directed by Head office, purely in isloated stores by accident. Whether this is enough to break the release date across the board I don't know.
I also heard of one GAME store in Camden being phoned by some desperate gamers, pretending to be from 'head office' and telling the store that another store had broken the release date, so they had the go ahead to start selling the game .... this pair of pranksters went into the store half an hour later and were sold the game .... :rolleyes:0 -

That of course is assuming that the customer could SEE the date, because it requires a magnifying glass for even someone with good eyesight to read. That's not CLEAR labelling as required by the law.
The policy says "In the unlikely event that we charge you more than the price shown on the shelf or on the product, we will give you your money back and you can keep the product. Your statutory rights are not affected." (Maybe someone can kindly confirm the current wording - since that was off of a pic taken last year.)
Anyway, it doesn't say "price shown on the shelf unless there's a date mentioned".
Presumably it is partly the laws against misleading pricing that Tesco is trying to guard against by providing the refund policy - such labels are definitely misleading and I think I read somewhere here that this has been upheld by Trading Standards - or if it hasn't it will probably be soon. Basically you're doing Tesco a favour by cleaning up their act.
Tell them you don't even KNOW what today's date is! Also that you didn't realise it was a requirement to know the date before going shopping!This too, shall pass.0 -

Last time I heard that happening was with one of the Harry Potter films (or maybe books). Asda I think broke ranks. As far as I know, Tesco have not commited the same sin. Certainly not of late.Who or what was I before you came in to my life

Incidentally, the 'thanks' were indeed sincere - I can't remember when I last bothered to use sarcasm as a tool in a confrontation - maybe I should try it at the CS desk when things next get heated! I guess that's partly with having young kids. I like to be honest and straight with 'em. Ironic then that our exchanges started originally with you picking up on my use of the word 'paranoia' - as in reference to clandestine r&r practices!
Oh, but I have to disagree with you on one thing - opinions are very, very, very important - even with r&r - IMHO that is!This too, shall pass.0 -

Following on from the good advice from Marine Boy (post #2979) in response to this problem, you could also argue that it's ludicrous to suggest that every customer should check the SEL date for every item they put in their trolley on every visit to the store.
If they are seriously suggesting there is some kind of onus on the customer to do this, perhaps you could tell the CS woman to place a large sign by the entrance saying.....
"DEAR CUSTOMERS, PLEASE CHECK THE S.E.L. DATE ON EVERY ITEM YOU BUY - IT IS YOUR RESPONSIBILITY TO CHECK THESE DATES, NOT OURS"
......as I am sure that 99.9% of customers are unaware that it's their job, not Tesco's job, to closely scrutinise every SEL in the store. Elderly people with poor sight, and busy mothers rushing round the store with children, should certainly be made aware of this.0
