Landlord selling house and I'm 6 mths pregnant

    There's been some news on the house, the LL was waiting for us, and is still happy to proceed, the stumbling block now is the council. They told me that if the April rates were in line with Marchs 30th percentile they were also happy to proceed.

    I checked the councils website every single day waiting for the April rates to be published. I phoned the council, I had the local councillor asking for me in case she could find out the new rates sooner, in the end I found out the new rates before the housing officer!

    Anyway they were in line with Marchs 30th percentile so I thought we could proceed, but then the council just threw up more hurdles and bureaucracy, I've been jumping through their hoops every day since last Thursday when I found out the new rates, sending off all information they need as soon as I found out they needed it by email so they received it immediately. Now it is in the hands of the finance department, I've been told not to count my chickens until they have approved the paperwork I sent in and to continue as though I have no alternative accommodation until the tenancy agreement for the new house is signed.

    The lettings agent for the new house have been wonderful and patient. I am going to chase up the council again today and if I have no luck then I will contact the local councillor again to see if she can apply some pressure and get some answers.

    I am hoping everything comes together, it's infuriating that the council just bumbles along at a snails pace hindered by protocol and procedures. Hopefully it all goes through ok and the new house will be ready sometime between the 10th-16th April. But they have told me so many times we are just waiting on something and then everything will be fine then when that thing happens they just produce more hurdles, so I am trying to stay quietly optimistic but not get carried away in case things don't work out

    They've told me because I am having to have a section and other reasons, they are not going to put us o a B&B if it comes to that, we're on the waiting list for temp accommodation but nothing is available as yet, but maybe they are just waiting to see if this other private rental goes through. If it falls through they may suddenly find some temp accommodation tomorrow, who knows?!

    In the meantime it's just a waiting game but they have had the paperwork they told me they needed for the private rental for three days now so I am going to chase them up when they open at 1pm
  • All I can say is good luck and ignore the posters moaning about the landlord. We all know you are not hanging on for the fun of it.

    Thanks Franklee, I have been advised to use the exceptional hardship plea should it get to that stage however I spoke to the council yesterday (finally tracked someone down!) and I have jumped the first hurdle! What I am waiting for now is for the letting agents to submit an invoice to the council for the first months rent, it will then go to the finance department, it will take them three days to process, once that is done I need to go and sign the contract and then it will all be done! Nothing is set in stone yet but short of delays in sorting the finance and contracts out I, touch wood, think everything will be ok!

    I had told my current letting agents that unfortunately we have nowhere to move to on the 5th but that I would let them know as soon as we did. Now I shall contact them again and tell them we have somewhere lined up and am just awaiting a date when we can move in

    Imminent or recent birth is included.

    This extends the time from 14 days to a maximum of 42 days.

    Personally I would prefer to move being heavily pregnant than having had a C-section and a young baby and another child in tow.

    Hopefully eastmidsgirl is now sorted, but timing is something to bear in mind for anyone else in this situation.

    It is not the OPs problem, or legal requirement to pander to the requirements of some failure of a buy to let landlord, who couldnt do his sums before taking out his mortgage, and is now trying to sell her home out from under her.

    The symptoms she described are entirely normal for a pregnant lady in her third trimester and it is neither reasonable, nor fair to expect someone in her position who is already a mother, to accommodate a parade of strangers into HER home, to oblige the sale of such.

    The OP has continued to pay her rent, and followed housing protocol as advised by the council. She is not taking anything that is not provided to her as a right.

    There are laws in place in the UK to protect tenants from exploitation such as this so the point is moot. If as a landlord you dont think housing law applies to you then you need to find a different investment vehicle.

    Cases like these just serve to highlight the fact that the private sector is neither fit nor suitable to provide wide scale rental accommodation to families in this country.

    Additionally, if as an individual you dont want to live in a country with a welfare system then there are plenty of 3rd world countries that will more suit your atavistic prejudices (look it up).

    Equally it is not the LL's problem that the OP's pregnancy is coinciding with his decision to sell his property.

    Sometimes LLs need to sell their rented properties and it is their right to do so. Normally I would've expected the LL to at least find out if the tenant wants to buy the property from him but if the tenant chooses not to or does not have the funds to get a mortgage than two month's notice is the norm to allow the tenant time to find someplace else to rent.

    Obviously it's a hassle for the tenant but that's one of the disadvantages of renting (balanced with the benefits such as not having to worry about the cost of repairs to the gas, electrics and plumbing as well as kitchen appliances). It would be spiteful of the OP to deliberately sabotage the sale of her LL's property since I get the impression things were pretty civilised beforehand. I mean ... I don't think the LL decided to sell the property just to spite the tenant. Had the OP been more helpful with the viewings (i.e. at least give the house a bit of a tidy beforehand) then the LL might have been more flexible in allowing three months instead of two.

    Every tenant has the right to remain in the property until the landlord has gained a court order for possession, and to live there undisturbed.

    However, this thread does illustrate why some landlords will not consider HB claimants, not because of the usual complaints about stereotyping them for anti social behaviour and arrears, but because they have a reputation for being harder to evict. They are more likely to seek assistance from the local council for housing advice and be told to ignore the notice served by the landlord.

    Exactly and the OP's LL was still willing to rent to her,where is her gratitude ?
