6 year old using debit card online

My 6 year old boy signed up to one of the child friendly virtual reality worlds. Used my debit card without permission.

Obviously I have asked for my money back. I think Distance Selling Regulations apply even though the company website says no refunds at all.

I am also concerned that they do not even ask for the 3 digit number on the back of the card never mind 3D secure password. Is that another avenue to secure.

I am not looking for advice on keeping my cards hidden, nor how to deal with my child.

Thank you

  • As you bear responsibility for the child, you are therefore responsible for his actions. This means that in effect, you authorised the transaction and as such it is not fraud and cannot be claimed back as fraud.

I do not believe DSR applies to 'online' goods such as online subscriptions, games, buildings in game etc? Is the website based in the UK, different laws may apply if they are not. They are under no obligation to offer 3DSecure (definitely the case) nor (I believe) even have to ask for security number, depending on their payment processor.
  • I agree that the DSR is not applicable here.

Looks like you will need to chalk this one down to experience and hide your cards better / deal with your child.

    Sorry!

regardless what happens you will have to log into the sercive and cancel all payments and delete your credit info from their database, as you don't want to be charged month on month for this website, as it is very likely a subscription service.

How much did he spend|? and how can he get to your card easily and know what to do with it when he's 6?

Crikey, that's one clever 6 year old! I'd be quite proud of him, to be honest (but would hide my purse and valuables in future!).

I must say I'm grudgingly impressed.

So many of my customers at work say they don't buy items online because they "don't understand how," yet it's so easy a 6 year old can do it. He must be bright for his age.

However, this does make me curious as to whether the website asked for the billing address.

    What website was it

This really comes down to the terms and conditions - it is possible to limit your right to cancel if the service has already commenced, however this needs to be clear in the terms and conditions. Do we have a link?

If it was me, I would write off the money and use it as an opportunity to teach your child about money and responsibility.
    Gone ... or have I?

They do apply to services, but the situation is not as clear cut as with goods.
