You are wasting your time, he just cannot understand that the vehicle just being on the public highway would be deemed as " use " .. One of my neighbours was done for it.
This is completely correct.
The RTA contains a lot of offences. They are not all committed in the same way.
Some offences e.g. a driving licence offence, are committed by driving / causing / permitting.
Other offences e.g. no insurance, are committed by using / causing / permitting.
The distinction is crucial.
The definition of "using" includes keeping it parked up. There is no requirement for the vehicle to be driven before the offence has been committed. The penalties are the same irrespective of how the offence is committed.
As others have said, if the vehicle is parked on a road or other public place, insurance is required.0 -
So where does traders insurance come into this. If I wanted to leave an uninsured car on the road outside my house, could I do it as long as a distant friend was willing to let it be covered (as long as it didnt move) under their traders policy??“Quis custodiet ipsos custodes?”

He would need to declare the vehicle as either his vehicle or a stock vehicle to the MID (Assuming he was going to have it in his possession for more than 14 days or was a permanent addition) the MID is the database the police and other authorities use to confirm insurance cover.
The other problem would have is should there be a claim he would be need to satisfy the Insurers that the car was his or in his custody for the purposes of his motortrade business.0
