    nationwide is one of the organisations i'm reclaiming from too..currently at the stage of threatening to take to court if they dont pay up (they have already told me they will not pay so sent court threat)

    I've heard they close accounts but haveto say the sample that u posted above , to me, seems like they are just warning you that IF you do not abide by their t and c then they will close ur account. Basically also saying that if u ask for anymore charges back then they will close ur account..well thats what it looks like to me...very sneaky of them

  • I am claiming back charges approx £3000. I am worried that they may want to close down my mortgage account...does anyone know if this is allowed ? i am up to date with mortgage payments...

    I got my charges, interest and court costs refunded......Can anyone tell me what I should be doing now?

    I got my charges, interest and court costs refunded, but on the morning that they did this, Nationwide charged me a further bunch of £30 charges for bounced direct debits. I contacted them and they refused to remove the charges. Today I got a letter (dated a week ago) which stated:
    'Although we have refunded charges to your account on this occasion, we are unable to provide you with a current account that is completely free of all charges if you breach the terms and conditions of your account. We will, therefore, expect you to comply with the terms and conditions of your account in future. If you are unable to do so, it may be appropriate for you to make alternative banking arrangements as it may me necessary for us to give you 30 days notice to close your account if further breaches of the terms and conditions arise.'
    Effectively, and bearing in mind today's refusal to remove the charges they slapped on last week, they are saying that they are about to close my account. I thought the Nationwide had stopped closing accounts, after adverse publicity.
    Can anyone tell me what I should be doing now? I am an undischarged bankrupt (thanks to the Halifax and their carry on), so will find opening another bank account almost impossible.

    Where does it say they are closing the account?

    It is a standard letter, the same as i recieved, basically saying that you must now keep your account in order, and not make any further claims, or they will close your account.

    Personally, i think that this perfectly acceptable, and although you are legally allowed to claim again, i don't think that you can then complain, if they say "enough' is enough", and throw you out.

    thay havent closed my account as far as i know but they have asked for the return of cheque book and card i have returned it and than a week later they sent the same letter this only happended after the court papers were accepted by them i faxed them saying i have returned them and to check there mail or trace the licence number on the envolope i havent heard anything since up to now
    please can anyone help me on what i do next bailiffs or what i do now with this defence? tyvm

    But surely the whole point of this excercise is that the charges they are charging are too high?? If the banks/BS haven't learnt that lesson after having to repay charges then thats their problem surely?

    All they need to do is reduce charges to be realistic and fair!

    If it was me then i would proceed with reclaiming further charges..and if the account is closed then make a complaint about them closing the account!

    banks and BS get their pound of flesh from their customers all the time..they would do best to take heed form all the money they are paying out and start to charge less to avoid any more claims.

  • My husband and I successfully claimed over £1500 in excessive charges over the past 6 years from Halifax.

    This past month (ie. since we have had their payment in our account) Halifax have paid a DD of £300 which they would normally have bounced and also paid a couple of other items which would have bounced. Our fault in the sense we should have ensured we kept enough in there to pay these items...

    HOWEVER, today a letter arrived asking us to pay the amount over our overdraft within 3 days.

    Our dispute now is that they have changed the way they manage our account as previously they would have bounced those items so now they charge for paying the items plus ask for you to pay within 3 days.

    We feel they're treating us differently now we have taken this issue of over-charging up with them. We shall therefore be taking our business elsewhere as we do have another current account we can use.
