    Its not part of a Chain and Im not sure if i can name them without getting into trouble. We want to make sure that we take the correct route.
    We are thinking of going to BBC Watchdog.
    So you have 'asked him to reconsider' and now you are thinking of going to BBC Watchdog.

    Sorry to say, I think your money is lost, because Watchdog is an entertainment programme which has the remit of filling a slot in the schedules and really, they don't care too much about your money - your story has to be really 'sexy' to catch their eye.

    You really are being rather wet here - the restaurant owner must know he can push you around and that you won't take the matter to court. The small claims court is the way to go - otherwise, just drop it and pay your colleagues back out of your own pocket - if you don't take it to court, your colleagues will probably force the money from you.

    Send the restaurant OWNER a letter recorded delivery stating that as he has broken the contract he has 14 days from the date of letter to return your money in full. A nother booking is not acceptable. Failure to do so will result in your claiming your money back through the small claims court which will incur him more costs.

    Then file at the small claims court if he does not pay. OP, do not be scared by this prospect (it sounds like you are) it is really very easy and the mere threat will more than likely have him refunding you.

    If he does not then you will do the following: Make the claim with the small claims court online. You fill the details in online and send the copy of the receipt and booking, along with a copy of the letter and recorded delivery slip to prove her has received your letter. Simply spell out that the Restaurant cancelled your booking and refuses to refund your money. They do not need emotions just facts.

    You will get a copy of the court papers, as will the manager. It will cost you £30 to file and you will get this back when he loses. You can also claim 8% interest for each day he has your money.

    IF he defends it (he is a fool if he does) then you will go to court, there will be you, him and the judge in a room around a table. The judge will then decide whether or not you get your money back.

    It is easy, if you needhelp then come back here and ask for it. How old are you OP? Also, who paid and how did you pay? Is there another of the party that can help you?

    Watchdog will not be interested, they will not get you back your money. If you want your money back then the above is how to go about it. But get things moving now, get the letter in the post.

    Dear Mr/Mrs x,

    Further to your cancellation of our booking on xx December 2010, I would like a full refund of the money paid (receipt attached) within 14 days. Rebooking the Christmas Meal is not an acceptable alternative.

    Should I not receive this refund within 14 days of the date of this letter then I will have no alternative but to take the matter to the Small Claims Court to receive my refund. Should I have to take this action then be advised that other costs will be added such as court costs, cost of wasted hotel accomodation booked for xx people (£ put the amount for the hotels booked) and interest at 8% per day.

    No further correspondance on this matter will be sent before taking this action. I look forward to receiving my refund, in full, by return so we can avoid this action.

    I am pretty sure that because you are going through small claims you can claim the wasted accomodation as you can add this on, just make sure you have all the receipts before filling in the box online. The judge can just say yes or no so it is better to add it and try your luck. Scare the cheeky sod in paying up!!

    If the restaurant was part of any chain then send the letter and claim to the Director/Managing Director of the company. I have claimed through the small courts for Cashback from a Mobile Company, people who we pay money to for a particular serivce should not be able to walk all over you once they have your money and this Small Claims service is there to help people like you in this situation.

    This is exactly what you need to do.

    Don't call them again, just write, and then small claims court

  • I would contact the restaurant and ask them again to refund the money, if they refuse then, as others have said, threaten them with the small claims court, and also threaten to take it to the papers, no restaurant wants bad publicity, especially through january when its the quietest time of the year for them,
