I think that if its a christmas party you should be entitled to have it at christmas, not January.0

My intepretation is that the restaurant if terms allow have opportunity to try and reschedule should it not become prolonged or awquard.
These are our opinions and intepretation of the law. Until the case law is produced or set neither of us are "right"
The OP booked a Christmas meal, therefore there is an implied term that the meal will be during the Christmas period. If the restaurant is not able to supply this, then they are in breach of contract and hence the customer is entitled to a full refund.Gone ... or have I?0 -

Of course if it was stipulated as an Xmas meal. A savvy restaurant won't necessarily have called it that.
Its quite probably a refund can be obtained but the OP would need to look at all the facts and terms first before he makes the phone call stamping his feet and ends up looking silly.
A lot of places for example call it a festive menu for the festive season. When exactly does the festive season finish?0 -

Have you ever heard of January being the festive season? The common sense approach would apply here.Gone ... or have I?0 -

Yes I have heard early January often being called the festive season. For example until the 4th it is festive holidays in Scotland.
Also a lot of places will have a validity period on their menu. If you buy a meal from a festive menu which states the festive menu runs until the 10th January and this coupled with the terms allows limited rescheduling I wouldnt say it would be a slam dunk.
That said a lot of restaurants wont have this or bother with terms and I suspect the OP will get his refund. He should just be aware of his terms etc before the feet stamping starts.0 -

You are really pulling at straws here - your argument is nonsense. You are completely missing the fact that a DJ will largely base their decision on what is reasonable, and what you are saying is not!
OK, another example - if you go to McDonalds and pay for a Happy Meal, is it ok for them to say 'Thank you for your money, but you can't have it until next week. The offer is still on then so we can do this!'?Gone ... or have I?0 -
Xmas meals are always much more expensive than the ones most places serve all year round. I'd be gutted to turn up in January and just get a regular meal! I hope you managed to get a refund for everyone, OP.From Starrystarrynight to Starrystarrynight1 and now I'm back...don't have a clue how!0

Why cant he accomodate you? Is he actually closing the restaurant? Where is the restaurant?Feudal Britain needs land reform. 70% of the land is "owned" by 1 % of the population and at least 50% is unregistered (inherited by landed gentry). Thats why your slave box costs so much..0

So they would not have got wages if you hadn't booked? Terrible excuse for not giving you your money back.0 -
Op is entitled to a full refund if they do not want to re-schedule,
however it seems like the restaurant is in financial trouble if they are using an excuse that they cannot refund as they have paid out the OPs money on the staffIMOJACAR
