Found a bargain on amazon, now they will not honour it

Was looking for a cd player for my daughters christmas present when i came across a real bargain on Amazon. It was a JVC midi hifi which was originally priced at £199 but it was saying it had a discount of 98% making it only £11. I checked and checked to see if i was reading it wrong but everything seemed fine so i placed my order. I had my confirmation from Amazon to say i had placed the order and the total was £21.35 inc p&p which i was happy with. Checked later that day and it was awaiting despatch. Then checked my online bank and they had taken the money from my account so i thought great. Checked order status again and it said "item despatched" then last night i had an email from the company to say there had been a pricing error and it should have been £113 and they cancelled my order. Money has not been refunded to my account yet though. Do you think i should try and complain or can they do this even though they had made the error?

    If they have taken the payment then that forms a contract which a court could enforce. The route you would have to take is to petition for so-called loss of bargain and if you won you would be entitled to the difference between the purchase price and the cost of sourcing from elsewhere.

    Cubegame is talking rubbish. Online a contract is not formed until an item has BEEN despatched, this will be in the T&Cs somewhere.

    But the staus of the item had been changed to "despatched"
  • 'Loss of a bargain' is a contentious subject really. That route would only be looked at if you had no reason to think that it was a misprice and the goods were worth the court fees for arguing it.

    Contract is generally formed by despatch for online orders. as per most companies T&C's. In store it is upon payment, not leaving the store.

    I'd move on myself :)

    But it stated item dispatched....Last year with the xbox glitch it told everyone that there orders were cancelled and loads of us still got it thru....so wait and see if it comes, you never know!

    Yeah sorry i did not get chance to post on grabbit but i was on my way out when all this happened yesterday so did not get chance. It was my intention to do it upon my return but they had sent the email to say there had been a pricing error and they had updated there website.
