    At the end of the day the OP needs to look in their policy terms and conditions to see what they say.

    Some policies will exclude damage to the insured vehicle if insurers are satisfied that at the time of the incident the driver was under the influence of any substance that would be considered an offence under the relevant law. I believe this indicates that if you were under the limit no offence would be committed so the insurance would pay.

    Some insurers may simply exclude any accident where drink or drugs is involved and not mention that an offence has to be committed. They cannot avoid third party liability as previously mentioned, but may choose to pursue the insured for their outlay.

    Nobody can comment without knowing the exact wording of the poster's policy.

    However at the end of the day, anybody who drives after drinking is an idiot and deserves everything they get, which in my view should include a mandatory suspension, heavy fine and in cases of high readings or habitual offenders, a prison sentence. Goes without saying that if they can get insured in the future, the insurance should be restricted to third party only cover and be heavily loaded.

    Wow. Some very vicious replies here in this thread that the OP doesn't deserve because until the blood sample comes back, no-one can say, including McKneff, for sure that the OP was over the limit.

    The blood test is offered when the breathalyser readings are sufficiently low that there is an element of doubt ... so to be calling for punishments when the OP may not be over the limit and may not have broken the law is unfair and rude - especially given they are a new poster.

    Different people have different standards about drink-driving, labelling someone as a troll just because they don't have exactly the same standards as yourself seems harsh. The OP might have hit the car on the slip road regardless - after all sober people do make mistakes while driving, do they not?

    The amount of alcohol in mouthwash is minimal , it wouldnt even register on a breath test.

    Which is exactly why i stated that people should not get behind the wheel of a car when they have had any amount of alcohol !

    Tell me , if a close member of your immedaite family was killed or maimed by a driver who was breathalised and found to be over the driving limit , would you still hold such a ridiculous point of view ? Would you forgive them because they were only slightly over the breathaliser limit ?

    Thought not !

    People get angry when a close family member is killed or maimed on the roads regardless of whether the driver who caused the incident was drunk or not.

    Unfortunately while you may be teetotal lots of people are not and will have drunk some time before they are driving.

    There are lots of people who go on heavy drinking sessions and are over the limit the next day. There as there are people who have drunk some alcohol hours before they drive and are completely sober. So simply saying you should get behind a car when you have had any amount of alcohol doesn't cover all situations and is unrealistic.

    I know certain people who are more of a menace on the road and should have never been allowed to drive and they are tea total.............

    It may make sense but that is not the law so if you are within the legal limits then you are ok.
