As above, keep the packaging and take photo's to prove what it was you recieved, and how much postage they paid (proves how little they sent). Seller thinks they've been really clever, but in reality it's a laughably bad attempt at a con as long as you do what PayPal tell you and prove that you have returned it.

Might have to use Special Delivery though, Recorded can be hit or miss on tracking....that is the one part you will lose out on, seller doesn't have to refund your return postage :(

Will use Special Delivery as it will be worth the guarantee so that I can get the majority of my money back. Thank you.

I wouldn't bother with a Snad. I'd open an item not received. The seller sent the item outside the 7 day period for any paypal seller protection so any tracking is not applicable. Open an INR in paypal not ebay (don't let paypal redirect you to ebay) Then escalate the case if they seller puts in the tracking number phone paypal and inform them of there own rules and that the tracking isn't applicable.

Be persistant with paypal sometimes they don't know there own rules. You can always quote the user agreement.

It's 11.7 on the user agreement

Sorry CB, where is this said. I'm not being a pedant, but the OP said the item was bought early Dec, but just received. With the snow it is still feasible the seller posted within 7 days. Or did I miss something?

Seems more hassle than it's worth. Opening a SNAD is perfectly valid and truthful...claiming item not recieved when it has been, despite being past some deadline, is just asking for the case to be drawn on longer than nessecery and risks losing doesn't it?

Admitedly, you probably have more experience that me with it though, just seems a riskier approach on the surface considering the seller has proof that the buyer recieved the item. Would it affect the chance of opening a SNAD later down the line?

  • Just received this via Ebay not Paypal.

    Hi there,
I can see you have opened a dispute with paypal but it was not necessary. I am really sorry you are not happy with your Lego, and I am more than happy for you to return the set for a full refund. There were 624 pieces in the box, and I will need to count they are all present before I can process your refund.
I will fully co-operate with Paypal, due to past bad experiences I photograph all parcels prior to sending, it clearly shows your details with mine on the reverse of the parcel which measured about 80cm by 40cm.
Am unsure as to why you are claiming you received 1 piece in an envelope, does this envelope have my details on the back? If not then it is not from me. I have been scammed in the past which is why I take these precautions. If I receive only 1 piece back then unfortunately I will be unable to refund you on this occasion.
Merry Christmas to you, and I trust the matter will now be closed ;-)

How do I respond to that? Do I just ignore it and wait for them to respond through Paypal?
  • How frustrating. If the seller is claiming they didn't send the piece of lego in an envelope, then the tracking numbers wont match. You need to check if they do match or not, and take photos of exactly what was received, making sure you get details of return address etc, and send it back by special delivery. I wouldn't respond to them in ebay, only in the filed paypal dispute.
  • the seller is a crafty bleep...

all i can say is be carefull because they might refuse the packet, also might be worth not making it obvious there is one lego piece in the evelope etc

just because they havent put their details on the back of the packet, doesnt mean it can not be traced back to them..

Oh my God is this seller for real?

How bloody cruel and dishonest to do that to someone when they must know the Lego would be for a child's Christmas gift.

I'd message them back asking them if they are having a laugh, because you haven't received a box of lego from them at all!

I wonder where they live, if they are anywhere near Merseyside, I'd quite gladly go and knock and get your lego or money!

  • Grrr, that made me really angry! What an absolute cheek.

I really hope you get a refund and that something really nasty happens to the seller, the crook.

    What an evil SOB.
Even if he had a photograph of the 'large' parcel... how on earth would it look like the one you received?
    My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j
  • Received via Paypal.

Will give full refund when set returned, was sent in a very large box I did not send any envelope and I have photographic proof of the parcel which I can provide for paypal. Box contained 624 pieces not 1, and all would need to be returned in order to receive refund.

    I have responded with:-

Many thanks for clarifying you did not send the envelope, perhaps you can explain why your tracking number is firmly attached to said envelope you did not send? I can provide physical (not photographic) evidence to Paypal if need be.

Wonder what his next trick will be, that i steamed the label off his box and glued it onto the envelope!
