    If you hit someone in the rear it is automatically your fault.

    Inactive is correct in what he says.

    Your video is completely irrelevant to the OP's situation anyway.

    There is no way you can say that if you hit someone in the rear then it is automatically your fault. There are so many variables to take into consideration.

    Most vehicle laws require drivers to follow at a safe distance and be able to stop for vehicles in front of them. If the driver can’t stop, it is generally assumed that he or she is at fault for causing the accident. However, this doesn’t mean that the rear-ended driver is always fault-free. Drivers whose brake or signal lights are out or those that don’t use signals or make extremely sudden turns or stops (i.e. driving recklessly or negligently) may be partially to blame.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.

    He would not have passed a basic driving test, driving like that, don't worry about an Advanced one.;)

    I think it's safe to assume the person in front would have benefitted from advanced indication of your intention to overtake, doing so could have avoided the whole incident altogether.

    They advised the Audi driver.:D That's because there was no evidence of any offences comitted by him.

    I was going faster and was quite near his rear end in lane 2, not going the same speed or I would not be overtaking, to overtake you must be going faster!

    Exactly, and therefore used in and at the correct time, as the Audi driver, (obviously oblivious to his surroundings), was being warned there was someone in the lane he was moving to, he actually did a similar thing a bit further along the same road, only this time he undertook 2 vehicles causing both to brake, hence why I took it to the police as he is a hazard on the road, (how many more times has he done it and will do?), if there was not a problem they would not have "advised" him, I was told if they had actually seen it rather than a video they would have taken different action.

    The only reason I put these on utube was for this thread, I will remove them when the thread dies down.

    I fail to see why you are having a go at me when I am completely in the right, (even the police agree), I was in lane 2, he moved from lane 1 when it was not safe to do so, end of!

    .I wonder how many of you lot would be taking the same stance if it happened to you? None!

    You used the horn as a sign of aggression and not a warning. Your language at the time backs that up.

    What's wrong with the second clip. All is see is you tail gaiting a Toyota and the Audi using lane 1?

    The horn was used at the earliest opportunity to warn him I was there, as he had obviously not used his mirrors, and he could/should have pulled back in, there was absolutely no reason for him to brake then pull out with his brakes still on.
    My language, with no one else in the vehicle, is what most people would say,( possibly under their breath), when confronted with such action.

    And you talk about me being incompetent, his lane was ending, he undertook 2 vehicles causing the Toyota to brake so he could, (again), have his way.

    I was not tailgating.

    At the very least he is guilty of inconsiderate driving, bordering on without due care and attention.

    ^^ I thought it was lane 2 ending? What would you call tailgating? The Audi was at fault as it should have merged in turn! But that would have been between you and the Toyota!

    The second clip is actually worse than the first. In the first clip whilst Derrick had a contributory part in the incident by overtaking late and not indicating, the Audi did not check his mirrors. However, in the second clip I'd pretty much put all the blame on Derrick. It's safe to assume the Audi is on the inside of Derrick. Derrick's lane is about to end and it's a merge point, so Derrick should be easing off to allow a cars length between him and the Toyota in front - instead he closes the gap forcing the Audi to make a decision, brake or accelerate. Audi went with accelerate. The whole incident was caused by Derrick not filtering properly. I'm guessing Derrick wanted to get one over on the Audi for the earlier incident.

    Is it still smarting that he got ahead of you?
