  • HIya, thanks for the reply. Sorry dont think i explained properly, they are registered, the one where they arent is a seperate loan. This one is through Welcome FInance who are registered, i have got all the documents insurance etc. Is it not worth me trying to claim on my own first, didnt want to have to get my ex involved unless i have to. Will check when i go home and look at the paperwork but i am pretty sure that he is the only one on the insurance policy :(

If this is a joint loan you would both have to sign to claim the ppi back.I dont know why the fos accepted a claim for mis sell from just you when it was a joint loan?.And if your ex is the only one on the ppi then again, they will need his request for ppi mis sell, you cannot do this without his agreement. They will not deal with this until they have both signatures, sorry.

They havent accepted mis sell. I havent contacted fos about this one yet as i havent done anything yet. The loan is joint but only my ex's name on the insurance. I have been paying the loan for the last 4 yrs since we split, so i am paying for insurance that is pointless as he is not paying it.
  • Hi guys

A bit of an update for you.....got my money in my account yesterday from Welcome!!!

I wasn't prepared to wait until after Xmas for it so I very politely kicked up a bit of stink and emailed everyone in Welcome and Cattles until something got sorted.

What a result and a very good Xmas in my house!!!

Many thanks to all who helped and good luck to those currently reclaiming, persistence always pays off eventually.

    Merry Xmas to you all.

This is awful, you are paying a loan back with ppi and your ex gets off scot free !!. You will i am afraid need his permission to claim mis sell for this. I dont think it is right that he should profit from a loan that you have paid. With the loan being in joint names you could get him to do mis sell with you and tell the loan company that this is 50/50 and as you have now split could they do 2 seperate cheques. Even though he is the only one covered by insurance you are still jointly responsible for the debt including the ppi, so i dont see the company having a problem with splitting a win with you.You are a "nicer person" than me, as i would not be paying this loan alone and my partner gets a way with it. I would want my pound of flesh:rotfl::rotfl: his wedding tackle would be my first port of call :rotfl::rotfl:

I regret it now, but when we split i just wanted an easy life so i agreed to paying it..silly me.:(

How do you think i should get things started? I dont know whether to do the questionaire on here, write to them, ask him to put a letter together confirming that we split and i have been paying it. Didnt really want to have to involve him, but i am friends with his sister still so i can go through her if needs be

Hi there, dont cancel the ins, you will have to do a new loan without ppi and this will be a longer term and apr. If you win mis sell, then your ppi total is taken off the loan so your monthly payment goes down by the ppi amount, the ppi paid to date is given back to you and your loan stays the same term and apr. Tell your ex that you are putting a claim in for mis sell and need his co operation. Either use the template off the site and attach another letter (signed by you both )to say you have split and if this ppi was mis sold you want 50/50 to each other. Before you do that ask your ex to sign and give his permission so that you can keep the win as you have paid this loan, you never know, he may just say yes..If you feel you can pen a few words yourself, then just send a letter for mis sell saying you believe you were mis sold this ppi because... and put your reasons, it is as easy as that!!! send everything recorded. Dont forget to get ex to agree to conditions.
