Bank account raided - advice please

    Done that too. Paid her directly with no complaints. CSA not accepting this yet though.


    Did the CSA forward this money?! if so then would you not have got it back if you were paying directly and you explained it to her?! has it since happened again?! are you financially crippled because of it?! ( am not sayin that it justifies if you ain't) but if you can move on...maybe its best?!

    Am in ongoing discussions with the CSA to establish which payments-in-kind can be allowed against arrears.

    I also have letters from CSA telling me to pay money directly to her, even though she was on benefits. So did what I was told.

    After section 32D of the Child Support Act 199(6)
    The Commission shall serve a copy of any order made under this section on (a)
    the deposit-taker or third party at which it is directed;

    (b)
    the liable person; and

    (c)
    if the order is made in respect of a joint account, the other account-holders






    Does this mean before the money is taken or after the money is taken?

    Can't really help with your predicament immediately but I would seriously consider either closing the bank account and opening a new one and NOT giving the CSA a DD permission or cancelling their DD at your bank -if possible-sometimes the bank will refuse (see point 1 below).

    About 12 years ago & a few years of paying maintenance quite happily the CSA got involved and put my contributions up 5 x overnight.
    I took advice from 'Families need fathers' and would urge anyone who has been assessed or is likely to, to google them and take their very knowledgable tips.
    i.e.
    1.NEVER, EVER sign over a standing order or direct debit, as: as the CSA are well known for removing cash from accounts whether owed or not, make all payments by Bank Giro Credit personally, they will supply slips for you to do this.

    Always pay on time however as they can and will get attachments for earnings even for as little as a weeks delay, your employer can (and most do) make a charge for administering these payments just to add insult to injury, and they have no power to refuse CSA requests for payment!

    The Irony is that the CSA are also VERY well known (and I have experience of that!) for taking monies that they are not entitled to and taking months to pay it back, with no interest, compensation or apology either!

    2.NEVER give them a telephone number they can contact you on, or they can & will then harass you at home.

    3.NEVER give them original documentation, they lose documents and then claim you never sent them! (again this is all too common!)
    Take all original documents to the local benefits office and have them make a 'certified copy' and send them internally, that way you keep the originals and they cannot claim they didn't get them either!

    I have no time for those who shirk their payments deliberately, but after being upfront and open and always paying my way I also have no time for the CSA or the current (or past) way it treated me and others: IME it goes after the easy, honest targets and is sometimes manipulated by cynical benefits thieves to obtain a CSA order initially.
    Unless specifically stated all posts by me are my own considered opinion.

  • Yes I'm serious. I have at least 4 Csa letters from the last 10 years saying that I should pay the arrears to the pwc. She was on benefits the whole time. She is a carer for our disabled son.

    In hindsight there must be some maladministration.
    What's the best course of action here?

    Can charge £1 for administration costs, The company I worked for didn't bother - I was the Payroll Manager, so had to deal with a few....
  • The bank charges £55 for helping the Csa empty it.
  • Well it must be hardly worth them charging a pound, sparkles?
