plusnet changing terms but charging me to leave

    Your wrong - they are in effect charging a cancellation fee.

    If Plusnet hadn't upped the price then the OP would stay for the remainder of the contract and not be charged. Therefore, they are early cancellation fees in all but name.

    As previously stated, it's Plusnet that are wishing to break the contract (by raising the price) so the OP can demand they either retain the contractual agreed price or terminate the contract without penalty. In this case, the penalties include the moving and router fees.

    You're slightly misstating what you agreed with Plus. The agreement you made in June 2010 was that they would give you a free router if you stayed with them for 12 months. You could have paid for it upfront and they are now asking for you to pay for it since you are leaving early.

    The underlined part was not part of the deal to get a new router.

    Plusnet is not charging you to leave. They are having you pay charges they deferred (exactly like the T&Cs said). If you had paid the moving fee and paid for the router upfront, you could leave for free.

    Right just to clarify:
    I know its not a termination fee that plusnet are charging they want paying for the router and moving house.

    When I moved house the moving fee was waved on condition I remained with them for a further 12 months and at the SAME monthly fee I was currently paying.

    When the router was replaced they did exactly the same, stay with them for 12 months and it was free and at the same rate I was currently paying.

    When agreeing both of the above I particularly ensured we discussed the currently agreement and fees to be paid.

    I remember these changes to conditions in contract law from uni. and will look it up, thats why I know i am right and so is heng leng.

    Sorry ...but if it went to court I think you would lose - extras,such as house moves and free routers, are external to the fundemental contract t & cs; You may think that you had a verbal agreement that was conditional on these two extras ...but unless you have a recording of the conversation or something in writing......

    you are right I did have a verbal agreement but do not have a recording and that is the problem.

    But I see it like this, when a company makes an agreement they should honour it, its the principle and thats what I am fighting for, I have always been prepared to fight back if we dont we are lost.

    I would suggest that you put ur request (cancellation /fees) in writing and request a deadlock letter if they refuse to your request.

    If needed, you can then contact CISAS and request they look into the problem. Their service is free for you (but not them ;)) and I would imagine your likely to be successful.

    I don't think she would lose in a court.

    If they would charge the fees regardless then they would be payable.

    But they have effectively agreed to waive them if the OP stays for the minimum term (12 months) - in this case they have brought the minimum term forward themselves by their price increase. To expect her to pay is a penalty charge for exercising her right to cancel.

    What is the price for a house move, the router price if bought from a PC shop could be anything from £40 upwards depending on the model, how much are they charging for the router?
    Will they accept the router back if you sent it to them?

    I agree with you in part, if you agreed to the contract and said 'I agree to the terms but I may change them as time goes on' they would not accept your terms but they can do it.
    Yes it is in the small print I know but a lot of these things are missed when signing up plus a lot of people sign up so to speak over the phone then get the paperwork later, usually comes with a load of bumf that goes in the bin but by then you are online and fairly happy
    so just file it away.

    caw99,might be worth posting on the actual Plusnet forum - I've found that their Customer care reps can sometimes cut thru' the c**p and solve the issues.Worth a try??:)
