    Completely agree with Guys Dad on this one, the offer was nothing to do with Orange, and it isn't up to them to cover a failed companies scheme.

    i have been done as well and its all well and good saying that you fell for it, dont you think we all know that! but i have spoke to a orange and excell plus midlands and they all put it on each other. when i spoke to midlands about my contract they said it was with orange so when i asked orange to lower my tarriff because i just could not afford it they said there was nothing they could do, i find orange very rude and told me it wasnt there problem and pritty useless, i even asked them about excell before i took it out and they said it was all fine and they were a very good company!!! i have been cut of and now getting court letters, i just dont know what to do

    My sympahies I had this with Cool New Mobile. I "lost" £180 in cashbacks when they went under.

    Your right, you have been done by Excell.

    The only response you are likely to get any money back is to sue Excell communication. But as they are in administration theres not likely to be much money, but you should at least lodge a claim as a creditor with the administrator. In the case of Cool New Mobile I got £30 or so of my £180 back.

    Orange don't have a respnsibility to pay you any cashback or reduce the tarrif, they would have paid out a commision to Excel based on the contract you signed, if you signed a £60 a month contract they would pay out more than a on £20 a month contract.

    In your case you need to accept you have a debt and need to pay it off, call orange and be humble, don't rant about the deal or blame orange it really is not their fault. Put your side of the story say you cannot afford to pay in one go and that you want to work out a way to pay this off.

    You may get a goodwill reduction, you may not, you should be able to work out a payment plan, but ignoring this and court letters is not the way to proceed. If you ignore court letters you will end up losing and have a judgement against you, and court costs added to the amount you owe. It will end up with a ruined credit file (it may already be ruined) county court judgements and possible debt collectors.

    The real injustice about all of this is that it was never put to me that I was entering into a contract with Orange. I have been with Excell Communications for 2/3 years, and I have always dealt with Excell in the case of upgrading etc. I also knew that they record the conversations where I enter into a contract with them (I know because I asked to hear them once). I have never been given terms and conditions by Orange either (I have kept all documents).
