This company offered me a business phone at a discounted rate, they paid £66 per month. They have now gone into administration and Orange want their money.
Anyone else had similar problems? Any Solutions?
I am told by Orange CS there are lots of people in the same position as me:mad::mad::mad::mad:

Can't believe Orange have taken this stance! Even if the issue is resolved I won't renew with Orange. Would have thought it's in thier interest to help the customers that they willingly took from Excell. Just gutted that I fell for a scheme like this, a lesson learned I suppose! Can I suggest everyone in the same boat writes to the BBC's Watchdog programme, perhaps we might get a better response from the network provider if they see it'll mean bad press for them! :mad:0

Orange would have paid Excell a commission to sign you up, and Excell would use that to pay you back. The system works as long as they keep getting new contracts. Whilst I sympahise (I've had it with Cool New Mobile) theres nothing that you can do. Your issue is with Excell not Orange.
When Cool New Mobile went under I was with Vodafone, Vodafone took a similar stance. Whislt I was hissed off I'd took the cashback on the grounds it was nice to have not vital to the contract, but I cna understand your feelings.
You cashback / redemption was ith Excell you need to log a claim with the administrator and see whats left, but if at the end of the day there is no money left thats then you will get very little.
Soirry its not better news.0 -
The point here is that any and every discounted scheme works on the basis that the reseller gets a commission from the network and passes some of it on to you, keeping the rest as his income. When the difference between the two is such that the business is not viable, the reseller goes goes bust. The better the deal seems, the more commission the reseller is passing on to you and the greater the risk of him going to the wall.
There is a way to avoid this, of course, and that is for the networks to cut out the middle man completely. That means no more Carphonewarehouse, Phones4U,mobiles.co.uk, dial-a-phone etc and, therefore, no cashbacks or cheap deals.
Do you want that? If you want to be 100% safe, then go straight to the network. Otherwise there will always be risks associated with going to resellers, but you are no worse off than if you took out a bog standard contract from the network.
Unfortunately, you went for a dealer whose trading model was unsustainable.0 -
Friend of mine in the same situation!!
Am appalled at Orange's stance as they only signed up with them as they were affiliated to Orange & they presumed Orange would have not been involved & run regular checks on affiliated companies. This cannot be the case as they only signed up in September & started having problems with Excell in October!! Excell must have been in trouble when they were signed up so why was Orange allowing them to sell their Airtime in September???? OFCOM need to look at Orange's procedures in place for monitoring companies affiliated to them.0 -

Why? Orange have done nothing wrong, as Brian points out your discount comes out of the commission that Excell would have got - that's nothing to do with orange, the discount you were getting from Excell has absolutely nothing to do with the actual contract with orange.0 -
Excell Communications are now Trading as Premier Phone Shop

Surely you can see that Orange have a legal responsibility to ensure that companies with a license to sell their contracts & trade on Orange's reputation. Are firstly extensively vetted. Then regular checks run to protect customers from being scammed & protect Oranges name.
From what I understand this company was signed over to another individual shortly before all this happened. Did Orange investigate this person at all one is left to wonder !!0 -

They have no legal responsibility at all in this matter, it's clear that they were acting as brokers in this matter, the only legal problem for orange would be if they (Orange) stop providing the service that people are paying for - that's not happening. Whatever people have to understand is that whatever rebate is agreed with Excell or whoever is nothing at all to do with orange, that's the same if you deal with them or the CPW or whoever. Now while this might lead to a bit of a PR headache for orange, that's not the same as a legal problem. Are firstly extensively vetted. Then regular checks run to protect customers from being scammed & protect Oranges name.
As far as I can see this wasn't a scam, it was simply a stupid business model that didn't work.Did Orange investigate this person at all one is left to wonder !!
Investigate them in what why? All that Orange is concerned about is that the customers they sign up (as middle-men) actually exist, what else people agree with Excell is legally nothing to do with orange. It's a completely separate contractual issue.
If I say to you, sign up via my company and I'll give you an xbox, that's contractual relationship is between you and me, Orange can't be held to provide the x-box if I don't supply one.
If you deal with middle-men, you simply have to be prepared for this to happen and if the deal seems too good to be true, ask yourself how they are making any money!0
